ORANG E COUNTY SHERIFF'S OFFICE GENERAL ORDER This order consists of the following: 1. Purpose 2. Policy 3. Definitions 4. Procedures 1. Purpose The purpose of this policy is to establish equity and uniformity for all exempt agency personnel in work hours. 2. Definitions A. Exempt Personnel – employees in positions that are exempt from overtime because of the duties they perform (e.g., executive, administrative, professional, and computer professionals) per Fair Labor Standards Act (FLSA). B. Standard Work Period - a consecutive fourteen ( 14) day period. 3. Policy It is the policy of the agency to comply with wage and hour law in establishing and maintaining positions. Exempt personnel at the rank of Lieutenant (or civilian equivalent), or above shall serve at the pleasure of the Sheriff. It is the policy of the agency to comply with wage and hour law in establishing and maintaining positions. All positions at the rank of Lieutenant (or civilian equivalent) and above, are considered exempt employees in accordance with this policy. 4. Procedures A. Exempt personnel are expected to devote at least 40 hours per week to their assigned responsibilities. Operational needs may dictate that additional work hours be performed without limitation. Revised work schedules may be authorized as needed by higher authority. If the time record shows any hours over the standard work hours, the employee is required to complete the “Comments” section. B. Exempt personnel are not entitled to receive or accumulate compensatory overtime referred to as "comp time". Exempt personnel will not be entitled to be paid for overtime, unless and to the extent that it is under declared emergency conditions and funded or reim bursed from a governmental source outside the agency. D. Exempt personnel annual and holiday leave will be in accordance with GO 4.1.0 .
