ORANGE COUNTY SHERIFF'S OFFICE GENERAL ORDER This order consists of the following: 1. Purpose 2. Definitions 3. Procedures 1. Purpose The purpose of this policy is to define practices which are consistent with the letter and spirit of the Federal Fair Labor Standards Act. 2. Definitions A. Actual Hours Worked – hours physically on the job. B. Basic Hours/Non -Sworn – include the total actual hours worked and/or leave hours taken up to 40 hours. C. Non-Sworn Sheriff's Employees - shall mean and include all full time classified positions within the Sheriff's Office, with the exception of law enforcement and management employees. D. Normal Work Schedule/Non -Sworn – an eight (8), ten (10), or twelve (12) hour daily shift, depending on assignment, with days off and hourly schedules established by a supervisor, totaling forty (40) hours in a standard work period. E. Standard Work Day – depending on assignment, consists of eight (8) , ten (10) or twelve (12) working hours , an unpaid one (1) hour meal period and two (2) paid rest periods of not more than fifteen (15) minutes each. F. Standard Work Period - a seven (7) day period. G. Work Area - the employee's designated working station (i.e., desk, etc.). 3. Procedures A. Work Hours 1. Traditional Work Hours For non-sworn personnel assigned to a section which operates on a non-24 hour basis, the duty period will be Monday through Friday, 8:00 a.m. to 5:00 Effective Date: September 25, 2020  Amends - GO 4.2.1 ( August 8, 2014 ) Number: 4.2.1 Distribution: All Personnel Review Month: August Reviewing Authority: HRD / Employee and Labor Relations Subject: Standard Work Hours For Non -Sworn Personnel 4.2.1, Page 2 of 3 p.m. In the event more than one person is assigned, the individual duty work hours may be staggered; however, the traditional work hours must be covered and comply with this policy. 2. Non-Traditional Work Hours For non-sworn personnel assigned to a section which operates on a 24 hour basis, the duty period will be determined by the operational needs of the agency. B. Meal Periods Employees will not be compensated for meal breaks. Meal breaks will be one (1) hour. When the interests of the agency dictate, the supervisor may direct that shorter than standard meal periods be taken, but under no circumstances will meal periods be less than thirty (30) minutes. It is the intent of this policy to encourage all employees to take a meal break away from their work area. C. On-Duty Meal Periods When staffing and operational requirements prohibit absence from the work area, supervisors may authorize consumption of meals while on-duty and on-premises at their work area as circumstances permit. Such on-duty meal periods will not exceed thirty (30) minutes in duration and will be regarded as time worked for pay purposes. It is the intent of this policy to encourage all employees to take meal breaks away from their work area. D. Rest Periods Rest periods will be counted as time worked for pay purposes. Rest periods will not be scheduled as the first or last fifteen (15) minutes of the work day. Rest periods will not be scheduled to extend the duration of meal periods. E. Employees shall not report to their respective work areas prior to the beginning of their assigned shift, without prior approval from their supervisor. Employees will not remain at their work areas, or continue working in any capacity after their assigned working hours, without prior approval from their supervisor. 1. All employees are required to report to work in a timely manner on the date and time scheduled unless their absence or tardiness has been approved by their supervisor or chain of command. 2. Employees shall not engage in a pattern of unexcused absences or tardiness. 3. When the interests of the agency dictate, supervisors may, with appropriate approval, authorize work beyond the forty (40) basic hours. The time worked in excess of forty (40) basic hours per work period will be compensated at the rate of straight hourly pay. The time worked in excess of forty (40) actual work hours per work period shall be compensated at the rate of one and one half hours pay. a. Compensatory time or paid overtime will be granted to all non-sworn personnel who have worked with supervisor approval, in excess of forty (40) basic hours during the work period. 4.2.1, Page 3 of 3 F. Recording Time Worked Employees shall record on their time record the total hours worked for each day on
