ORANGE COUNTY SHERIFF'S OFFICE GENERAL ORDER Effective Date: February 20, 2024  Amends – G.O. 4.1.2 ( August 11, 2023 ) Number: 4.1.2 Distribution: All Personnel Review Month: January Reviewing Authority: HRD / Employee Labor Relations Subject: Holiday Leave / Personal Leave This order consists of the following: 1. Purpose 2. Policy 3. Procedures 1. Purpose The purpose of this policy is to provide compensation to an employee during recognized holidays and when the employee chooses to utilize personal leave they have accrued. 2. Policy It is the policy of the Sheriff to grant holiday leave and/or personal lea ve to all full -time and part -time employees. 3. Procedures A. The Sheriff provides 11 paid holidays during the ye ar for all full -time employees. The holidays observed by the Sheriff for each calendar year are de scribed on a holiday schedule. This holiday schedule is to be utilized as the official notification for recognized holidays and is distributed to all employees via e -mail and posted on the agency portal at the end of each calendar year for the following year. The Sheriff may specify holidays as dee med appropriate. B. Holidays that are normally observed are: 1. New Year's Eve 2. New Year's Day 3. Martin Luther King Jr. Day 4. Presidents’ Day 5. Memorial Day 6. Independence Day 7. Labor Day 8. Thanksgiving 9. Friday after Thanksgiving 10. Christmas Eve 11. Christmas Day C. The paid holiday schedule for bargaining unit members is outlined in the Collective Bargaining Agreement (s). Bargai ning unit members and civilian personnel with 4.1.2, Page 2 of 3 Monday thru Friday operating schedules shall recognize the “Observed Holiday .” Bargaining unit members and civilian personnel assigned to 24/7 shifts shall observe the “Actual Holiday .” D. Unless otherwise directed by the Sheriff for payroll purposes, whenever a designated holiday falls on a Saturday, the preceding Friday is observed as a holiday and whenever a designated holiday falls on a Sunday, the following Monday is observed as a holid ay. For payroll purposes, when a holiday occurs during requested time off (i.e., vacation, compensatory or sick leave), holiday taken will be used. E. If holiday leave cannot be granted by the immediate supervisor, appropriate compensation will be awarded to individuals required to work on holidays. F. Non-Exempt Employees working on an agency -recognized holiday will be compensated as follows: 1. Employees working their normal assigned shift shall be compensated for the holiday as compensatory time, holiday pay or a combination thereof up to their regular schedule . 2. Employees working a partial shift on their regularly scheduled work day shall be compensated for the hours worked as compensatory time, holiday pay or a combination thereof. Hours not worked shall be holiday taken. G. When an employee's regular d ay off falls on an agency -recognized holiday , they may choose to take compensatory time; holiday pay or a combination thereof. H. In addition to the 11 recognized holidays referenced in Section B , agency members shall receive 2 floating holidays off, which can be taken at any time. Floating holidays must be taken during the calendar year and will not carry over from one year to the next. 1. Bargaining unit members assigned to the Courthouse shall receive 11 paid holidays throughout the year as designated by the Chief Judge and 2 floating holiday s off. The floating holiday must be taken during the calendar year January 1st – December 31st and will not carry over from one year to the next. 2. In the first pay of October, part-time employees ( not including school crossing guards and as defined in GO 4.6.12 ) shall receive a maximum of 40 hours of vacation time per fiscal year. This can be used for holidays or any other day the part -time employee chooses. 3. In order to receive the vacation benefit s award , part -time employees must have worked a minimum of 1,040 hours during the previous fiscal year . 4. Vacation hours for part -time employees cannot be carried over from one fiscal year to the next. 5. Employees requesting to use vacation pay must submit the request via e -mail to the unit supervisor. The date and time of the e -mail will serve as the 4.1.2, Page 3 of 3 submitted date. Vacation hours used shall be reflected as vacation on the Time Entry Forms. 6. Employees who resign or retire in good standing from the agenc y prior to the end of the fiscal year may receive a pay -out of their unused Part -time v acation hours. I. Part-time employees (not including School Crossing Guards) will receive holiday pay for Thanksgiving Day, the Friday after Thanksgiving, Christmas Eve, and Christmas. They will also receive two (2) Floating Holidays to be used during the calendar year and will not carry over from one year to the next. NOTE : Consistent with GO 4.6.12 , part-time employees who are eligible to receive the holiday leave cannot utilize more than their scheduled shift hours for the holiday and must not exc eed 39 hours in a week when holiday leave is used. J. Employees who are suspended without pay are not el igible for holiday pay if
