OFFICE OF CHIEF OF POLICE OAKLAND POLICE DEPARTMENT SPECIAL ORDER NO. 8793 TO: All Personnel SUBJECT: Update of Departmental General Order (DGO) J-3, TOWING PROCEDURES (Rev. 7 Apr 00) and Report Writing Manual (RWM) T-19, TOWING PROCEDURES (Rev. 7 Apr 00) EFFECTIVE DATE: 25 Nov 07 TERMINATION: Upon Revision of DGO J-3 and RWM T-19 The purpose of this Special Order is to revise Departmental policy and procedures, and the tow matrix for members and employees regarding abandoned vehicles. New language is added to DGO J-3 and is referenced as Part 1, C, 2, b, (4) to read as follows: (4) Repeat Violation - A repeat violation occurs when a vehicle has been previously processed in accordance with Part I, C, 2, a, of this order at the same location or within 50 feet. Abandoned Vehicle Unit Members may authorize the removal of a vehicle with repeat violations based on a completed Declaration in Support of Vehicle Removal (TF-3282) signed by the complainant or a complainant-written declaration'. Either of these signed documents will enable a member or employee to forego placing a warning sticker on the windshield, recording mileage on the Assignment Report, marking the tire and pavement, and waiting the mandatory 72-hours, prior to towing. A "complainant-written declaration" shall be signed by the complainant and state a factual basis supporting probable cause and include the language, "I declare, under penalty of perjury, that the contents of this declaration are true and correct."
