I. CIVIL PROCESS General Order # 15 Effective: 7/13/2023 CFA 24.01 APPROVED: CHIEF CARLOS NORIEGA POLICY It is the policy of the Department to execute civil processes as directed and to aid and assist other agencies in the service and execution. DEFINITIONS AOA – Assist Other Agency. Civil Process – Those writs, summonses, mandates, or other processes issued from a court of law or equity pertaining to a cause of action of a civil nature and directed to the North Bay Village Police Department. Execution – The performance of an act required by the writ, warrant, or other process commanding the seizure of a person or thing, as opposed to the mere delivery of an instrument without any accompanying seizure. Legal Process – Any item of the civil or criminal process, whether original, intermediate, or final, that is valid on its face and is to be served or executed by a law enforcement agency. OIR – Offense Incident Report. Service – The delivery of any item of civil process that is complete with the act of delivery and does not require physical or legal seizure of a person or thing.
