SUBJECT: Public Health Order Violations
INFORMATION:
This training bulletin serves to explain the updated procedures for Public Health Order
violations .
Effective immediately , the County will be primary for all non- urgent PHO calls. Non -Urgent
may include facial covering complaints, restaurants in violation of the PHO, or gyms operating above capacity. Urgent calls, such as a large gathering at a park or a disturbance over face
coverings, will continue to be handled by patrol , regardless of the time of day .
Santa Clara County (SCC) has created the Community and Business Engagement Branch
(CBEB) within the County’s Emergency Operations Center, to handle non- urgent Public He alth
Order (PHO) violations. The Branch is a joint partnership with Public Health, the SCC District Attorney’s Office and the Office of the County Counsel. Previously, the DA’s Office was
handling PHO violations criminally. While the approach of CBEB is still one designed to educate and inform, re quest compliance, and finally enforcement, they will do so through
administrative citations. CBEB is the enforcement branch and has a team of approximately 25 enforcement officers who
will respond to PHO compla ints. They have County photo identification and will not ask for
money on scene. Subjects have started impersonating CBEB personnel thus we may receive calls from a business or citizen to verify credentials. A second SCC group, Community Health
and B usiness E ngagement T eam (CHBET) is providing outreach to businesses throughout the
county to inform, educate and help businesses comply with the Public Health Order . They will
not do enforcement but work with CBEB and may make referrals when a business is no t willing
to comply.
