MOUNTAIN 2020 POLICE VIEW MOUNTAIN VIEW POLICE DEPARTMENT OPERATIONAL SERVICES UNIT TRAINING AND INFORMATION BULLETIN DATE: 02/11/2020 BULLETIN NUMBER: 20-03 SUBJECT: Sidewalk Vendors (Senate Bill 946) PAGE 1 OF 1 INFORMATION: On January 1, 2019, Senate Bill 946, also known as the Safe Sidewalk Vending Act, went into effect, which decriminalized sidewalk vending. Instead, a violation may only be punishable by an administrative fine, pursuant to an ability-to-pay determination. Mountain View City Ordinance (MVCC) Chapter 15 (Mobile Vendor) was amended. We may now issue mobile vendors administrative citations for violation of MVCC 15.15 - Permit Required. Fine amount: First offense Second offense $250 $500 Third & Subsequent offense $1,000.00 A case number is optional but you should take notes in case if the vendor contests the administrative citation and at a minimum add the citation number to your Officer Worn Camera incident tag. Mobile Vendors can obtain a mobile vending permit through the City Hall Finance Department but in order to receive a mobile vendor permit, applicant must obtain all required local, state and/or federal permits to operate (Mobile Vending Application). It is important to understand MVCC Chapter 15 is non-criminal and only administrative citations shall be used when issuing a citation. If you issue an administrative citation, you will have to provide the person with an "Ability to Pay" form (PD-210A).
