DEFINITIONS:
CRIMINAL ACTIVITY - Conduct prohibited by statute, ordinance or regulation,
regardless of motivating factors. The term criminal activity will include terrorism. Under
the Homeland Security Act of 2002, terrorism is defined as activity that involves an act
dangerous to human life or potentially destructive of critical infrastructure or key
resources and is a violation of the criminal laws of the United States or of any State or
other subdivision of the United States in which it occurs and is intended to intimidate or
coerce the civilian population or influence a government or affect the conduct of a
government by mass destruction, assassination, or kidnapping.
CRIMINAL INTELLIGENCE - Criminal intelligence is data that has been evaluated or
analyzed to determine that it is relevant to the identification of and the criminal activity
engaged in by an individual who, or organization, that is reasonably suspected of
involvement in criminal activity. It is information that is developed from data gathered by
investigators and analysts. Criminal intelligence, because it has undergone some form
of evaluation or analysis, indicates to law enforcement that the subject may be involved
in some definable criminal activity.
EVENT PLANNING - Information gathering for the purpose of facilitating police and
public safety planning and activities associated with parades, demonstrations and other
protest activity or events of public expression. Event Planning is not an investigation.
INFORMATION - Facts, data or knowledge gathered in any way.
INVESTIGATION - Police activity undertaken to obtain information or evidence.
LEAD - Information obtained or developed by any member of the Department that may
justify a criminal investigation.
PROTEST ACTIVITY - An expression of objection, whether organized or spontaneous,
by word or by action, to particular events, policies or situations to include but not be
limited to demonstrations, marches, rallies, counter-demonstrations, sit-ins,
occupations, work stoppages, strikes, walk-outs, pickets, and boycotts.
PUBLIC - Public includes any person and any entity, organization, or association, any
government entity for which there is no existing specific law authorizing access to
Department information, media organizations and entities that seek, receive, or
disseminate information for whatever reason, regardless of whether it is done with the
intent of making a profit, and without distinction as to the nature or intent of those
requesting information from the Department.
REASONABLE SUSPICION - Reasonable suspicion is established when information
exists that establishes sufficient facts to give a trained law enforcement officer,
investigator, or analyst a basis to believe that there is a reasonable possibility that an
individual or organization is involved in, had been involved in, or was about to be
involved in a definable criminal activity or enterprise.
