I. Sworn Personnel A. Promotional Procedures 1. A promotional examination will be given every two years, unless the Fraternal Order of Police (FOP) President and the City Manager mutually agree to some other schedule. 2. By City Ordinance, the City’s Human Resources Director is assigned the responsibility and authority to administer all facets of the promotional process. The City Human Resources Director or designee conducts all promotional examinations in conjunction with the Department. 3. Advancement to the ranks of Sergeant and Lieutenant will be by examinations that measure the knowledge, skills, and ability of personnel and by seniority points, education points and Veterans Preference Points. 4. The City Human Resources Department (HRD) or designee will administer such examinations and prepare a promotional register, one for Sergeants and one for Lieutenants, containing the names of persons who have passed the examination ranked in order of such examination scores. Promotions will be by rank order. 5. Only job related and non-discriminatory promotional examinations will be used. 6. The HRD or designee is responsible for the security of all promotional materials. B. Eligibility 1. Eligibility will be in accordance with the City of Miami Beach Personnel Rules and the current contract between the City of Miami Beach and the FOP. a. All employees must have a valid Florida Driver’s License. b. All employees must hold a current State of Florida Certification for police officer and have met the continuing training or education requirements outlined in Chapter 943, Florida Statute. 2. Applicants for the Sergeant’s and Lieutenant’s examinations must apply on or before the application cut-off date and time in accordance with the City’s Personnel Rules to be eligible to test for promotion. Applications will be made available to prospective candidates at the HRD. 3. The City Manager or designee for Human Resources may refuse to permit an applicant to take the examination on the grounds of conduct disgraceful to the Department and their officer status; or refused advancement from probationary status. In the latter case, if at least three years have elapsed since such failure of probationary advancement, such candidate will be considered qualified. 4. Should any applicant(s), so disqualified for any of these alleged reasons, contest such disqualifications, they will have access to the grievance procedure under the current FOP collective bargaining agreement. 5. Promotion to the rank of Sergeant and Lieutenant is based on a promotional process. Appointments to the rank of Captain or above and other positions designated as unclassified are exempt from the promotional process and are made at the discretion of the Chief of Police. 6. The position of detective is not considered a promotion and will not be based on competitive examination. 7. When appointed to a law enforcement position in the unclassified service, the individual must meet all state certification requirements or be enrolled in school to obtain certification within 180 days of appointment. 8. All police officers who, on the date of the written examination, have four years of seniority from the date of appointment to police officer or police officer trainee, and have performance evaluations of satisfactory or above for the preceding 24-month period, will be eligible to take the Sergeant’s examination. 9. All Sergeants who, on the date of the written test, have two years seniority from the date of appointment as Sergeant and have performance evaluations of satisfactory or above for the preceding 24-month period, will be eligible to take the Lieutenant’s examination. C. Promotional Examination Announcement 1. The Department and HRD will issue a written promotional examination announcement to the FOP and its members at least 90 days prior to the testing date. The announcement will: a. Delineate the positions available and eligibility requirements; b. Indicate the dates, times and locations of all examinations; c. Explain the application process and deadline date(s); d. Specify scoring procedure and qualifications for certification list; e. Provide a description of the test material chosen for the written test and for the Assessment Center; f. Provide any additional pertinent information; g. A list of study materials will be attached to the announcement.
