DEFINITIONS:
HOSTILE ENVIRONMENT - Is one type of harassment that occurs when the
alleged conduct is based on sex or some other protected characteristic and is
severe and pervasive enough to create an objectively hostile or abusive work
environment for the employee.
QUID PRO QUO - Is one type of harassment when submission to, or rejection of,
unwelcomed sexual conduct by an individual is used as a basis for employment
decisions affecting the employee.
SEXUAL HARASSMENT - Offensive and unwelcome sexual conduct that affects a
term or condition of employment and/or has the purpose or effect of unreasonably
interfering with an employee’s work performance or creating an intimidating, hostile or
offensive working environment. The conduct must be unwelcome in the sense that
the employee did not solicit or incite it, and in the sense that the employee
regarded the conduct as undesirable or offensive.
THIRD PARTY HARASSMENT - Third-party sexual harassment occurs when
someone not associated with the employer sexually harasses an employee.
Examples of third parties that may engage in sexual harassment include vendors
and suppliers.
