POLICY AND PROCEDURE JUVENILE PROCEDURES Page 2 PURPOSE The purpose of this directive is to provide guidance for the detainment/arrest of juveniles and to provide alternatives to these arrests. DISCUSSION This directive will provide procedures for taking Juveniles into custody or to detainment. The directive will also provide procedures for the Interstate Compact Issue, which supersedes Florida State Law regarding the detention of runaways and other juveni le status offenders. POLICY 901.1a It shall be the policy of the Maitland Police Department to use the greatest possible discretion when dealing with juveniles. It is Department preference that an arrest will be the last option in those cases involving juveniles aged twelve (12) or younger whom are involved in minor offenses, and with insignificant prior criminal involvement. 901.1b A child younger than seven (7) years of age may not be arrested or charged for a delinquent act or violation of criminal law based on an act occurring before h e or she reaches seven (7) years of age, unless the violation of law is a forcible felony as defined in F.S.S. 776.08. 901.1c In all cases, the constitutional rights of juveniles taken into custody will be protected regardless of whether or not the juveni le will be processed or field released. 901.1d The arrest of a juvenile age twelve (12) or younger shall be limited to cases where members make all reasonable efforts to divert the juvenile from entry into the juvenile justice system. In cases where there are no immediate public safety concerns and charging the juvenile is appropriate, m embers shall: prepare an affidavit for a Juvenile Custody Order, complete a Juvenile Release Agreement (if qualifies), complete a Juvenile Civil Citation (if qualifies), or submit the charges to the State Attorney’s Office as an at large affidavit for cons
