DISCUSSION Within every law enforcement organization, it is an absolute necessity that certain confidential information be maintained, that is not obtainable through regular law enforcement channels, on organized criminal activities and the persons involved. These fi les are not related to the records kept by the Records Division, and are used as an aid in combating organized criminal conduct that presents a threat to the community. MAITLAND POLICE DEPARTMENT POLICY AND PROCEDURE INTELLIGENCE FUNCTIONS/ USE OF INFORMANTS Page 2 POLICY 602.1a Criminal Intelligence gathering is principally concerned with the collection, analysis, and dissemination of information limited to criminal conduct and relates to activities that present a threat to the community. DEFINITIONS 602.2a ACTIVE CRIMINAL INTELLIGENCE : Information concerning “an identifiable person or group of persons collected by a criminal justice agency in an effort to anticipate, prevent, or monitor possible criminal activity.” Such information is considered “active” as long “as it is related to intelligence gathering conducted with a reasonable, good faith belief that it will lead to detection of ongoing or reasonably anticipated criminal activities.” Active Criminal Intelligence is usually, but not always, informati on that focuses on a single event, pattern crime, and/or accusation of criminal activity. The Active Criminal Intelligence submission has a shorter useful life and retention time that of an organized crime/vice intelligence file. 602.2b ORGANIZED CRIME INTELLIGENCE FILE: An intelligence file is a focused collection effort on an individual or group and designates an ongoing information -gathering effort. Retention and review dates for intelligence files are longer than an active criminal intelligence submission, but will not exceed five years. 602.2c SUBMISSION: A memorandum, report, or other means of transmitting information concerning suspected criminal activity to the Criminal Investigations Division. RESTRICTIONS ON THE COLLECTION OF INFORMATION 602.3a The following prohibitions govern the collection of intelligence data: 602.3b Intelligence data will not be collected on any person or organization merely on the basis that such person or organization supports unpopular causes. Members will not collect or maintain criminal intelligence information about the political, religious or s ocial views, associations, or activities of any individual or any group, association, corporation, business, partnership, or other organization unless such information directly relates to criminal conduct or activity and there is reasonable suspicion that the subject of the information is, or may be, involved in criminal conduct or activity. 602.3c No member will engage in, or direct any individual to engage in, illegal activities in the collection of intelligence data. No intelligence information obtaine d in violation of any Federal, State, or local law will be included in the intelligence system. 602.3d No member will provide confidential information to any person without the express permission of the Chief of Police, CID Supervisor, or a designee. 602.3e No member will use confidential intelli gence data for personal, political, and/or economic gain. MAITLAND POLICE DEPARTMENT POLICY AND PROCEDURE INTELLIGENCE FUNCTIONS/ USE OF INFORMANTS Page 3 602.3f Non-criminal persons, organizations, and/or businesses will only be documented in the intelligence system when they are relevant to suspected criminal activity. Non -criminal identifying information cannot be its own file in the intelligence system, but can only be added to an existing file or record of a subject who already meets the standard of reasonable suspicion. If entered, they will be cl early identified as non - criminal associations within the narrative of the submission. 602.3g Only information that rises to the level of reasonable suspicion of criminal conduct will be entered into the intelligence system. SUBMISSION OF ACTIVE CRIMINAL INTELLIGENCE INFORMATION 602.4a Active Criminal Intelligence Information may be submitted to the Criminal Investigation Division via an offense report or memorandum.
