It is the responsibility of all personnel, particularly sworn officers, to actively support such prevention and control effort s while respecting the rights of juveniles, as well as the safety of the public. Florida Statutes specify procedures relating to juveniles. General Orders of the Kissimmee Police Department shall conform to state statute and any other applicable laws. 411.01 Taking a Child into Custody: [CFA 16.01M – A] Physical custody is one of several options available to officers in dealing with juvenile offenders. Officers should use the least coerci ve of these alternatives that is consistent with preserving public safety, order, and individual liberties. a. Pursuant to an order of the court such as a pick -up order [CFA 16.02M – A] or an arrest warrant; b. For a delinquent act or violation of law, if the child is 8 years of age or older or the violation of law is a forcible felony as defined in Florida Statute Section 776.08, pursuant to the laws of arrest; c. For a child in need of services; [CFA 16.02M – B] d. When a child is in imminent danger; [CFA 16.02M – B] e. When the officer reasonably believes that the child is a runaway; [CFA 16.02M – B] f. When the officer has pro bable cause to believe that the child has violated terms of community control, furlough, or aftercare; and/or [CFA 16.02M – A] h. Under the authority of the Marchman Act or Baker Act per Florida Statute. [CFA 16.02M – A] 411.02 Arresting Officer Responsibilities : [CFA 16.01M – A] In all cases when a child is taken into custody, the arresting officer shall: a. Confirm notification of parents, guardian, or legal custodian without unreasonable delay; [CFA 16.03M – B] b. Confirm that the child is not detained, either in a vehicle or detention facility, with an adult, unless the adult and juvenile are arrested for the same offense or the juvenile has been adjudicated as an adult under legal guidelines; [CFA 16.03M – E] c. Confirm male and female juveniles shall not be transported together unless they were involved in the same incident and independent transportation is not available; d. Confirm the juvenile has no verbal or visual contact with an adult prisoner while in the Polic e Facility; [CFA 16.03M – E] e. Confirm that the child is informed of their Constitutional Rights before any custodial interrogation. The atmosphere of the interrogation should be non -intimidating. Consent of the person representing the best interests of the child (e.g. parent, guardian, legal custodian, or attorney ) is desirable but not essential if the child is capable of understanding their rights and the significance of waiving those rights. Factors to be considered in this regard include age, marital sta tus, education, and intellectual level. Interrogations must also be for a reasonable length of time; [CFA 16.03M – A] f. Confirm the delivery, without undue delay, of the child to an appropriate receiving facility or to the parent/guardian unless the child i s in need of emergency medical treatment. In this case, the officer shall confirm that the child is transported, without undue delay, to the nearest hospital; [CFA 16.03M – D] and/or g. Confirm that the Superintendent of Schools, or their designee, is notifi ed in cases of juvenile arrests for felony and violent offenses. This shall be accomplished by having the Records section fax a copy of the charging document to the Osceola County School Board. 411.03 Pick -up Orders/Arrest Warrants : [CFA 16.01M – A] An officer may arrest a juvenile upon probable cause to believe that a valid arrest warrant or court -
