It is also essential that the Department maintain integrity and public respect by providing the general public with an environment where they are not subjected to law enforcement miscond uct or abuse. To ensure these ends, the Kissimmee Police Department has adopted a formal complaint procedure. The Chief of Police and representatives shall maintain discipline for misconduct and shall take appropriate action. The Internal Affairs Unit has the responsibility of supervising and monitoring the disciplinary procedure on behalf of the Chief of Police. 202.01 Procedure: The Kissimmee Police Department has established and put into operation a system for recording, registering, and controlling all complaints and investigations of alleged or suspected misconduct within the Department. All complaints alleging employee misconduct shall be handled in a manner that ensures each is addressed effectively, through an adjudication process that is based on th e principle of fair and equal treatment for all and that also complies with all applicable rules of law. KISSIMMEE POLICE DEPARTMENT General Order 202 Page 2 of 19 The Department shall professionally and thoroughly investigate all allegations of employee misconduct in a manner that ensures the rights of all persons are protected throughout the investigation and subsequent proceedings. 202.02 Reporting of Alleged Violations: Supervisors shall document instances of work rule violations directly into the Internal Affairs data management system (BlueTeam) , or by reporting alleged violations to the appropriate supervisor , or via memorandum , to Internal Affairs for further investigation . Any employee establishing a pattern of carelessness, negligence, or incompetence through documented deviation from work rul es, or Internal Affairs Unit records, may be alleged to have violated Standards of Police Department Conduct. Minor work rule violations may be handled via coaching sessions or entered into the City Employee Performance Module as a “boost” which documents an area where an employee needs to improve and is not considered formal discipline. All alleged or suspected violations of the laws, statutes, or ordinances of the United States, State of Florida, City of Kissimmee, or any Department regulation, direct ive, or lawful command coming to the attention of any Department employee shall be reported as soon as practical using the appropriate format. 202.03 Receipt of Complaints: When an employee receives a complaint from someone outside of the Department against another employee, they shall refer the complainant to the appropriate supervisor or to the Internal Affairs Unit . a. Complaints shall be accepted from any source, whether made in person, by mail, or by telephone; b. Complainants should be enco uraged to submit their complaint, in writing, utilizing the Allegation of Employee Misconduct form ; c. Anonymous complaints shall also be accepted . d. An employee receiving a complaint shall contact an on -duty supervisor. The supervisor shall make contact with the complainant and attempt to satisfy the complaint if possible or refer to the proper investigating authority. e. The receiving supervisor shall also secure any relevant evidence provided by the complainant. These materials shall be forwarded to the proper investigating authority. Should the complainant refuse to sign the Allegation of Employee Misconduct form , the supervisor or manager shall write “refused” on the signature line and sign their name. Exception: The Allegation of Employee Misconduct form need not be signed when: a. The Complainant is a member of the city government. b. The Complainant is a member of any governmental agency.
