KISSIMMEE POLICE DEPARTMENT GENERAL ORDER General Order 112 – Bias-Free Policing Page 1 of 3 TITLE: BIAS -FREE POLICING 112 EFFECTIVE: 07/01/2015 REVISED: 09/12/2025 SCOPE : ALL EMPLOYEES REVIEW AUTHORITY: OFFICE OF THE CHIEF CFA STANDARDS: 2.06M (A-F) 112.01 Bias Based Profiling 112.05 Procedures 112.02 Stop 112.06 Training 112.03 Detention 112.07 Complaints 112.04 Reasonable Suspicion 112.08 Administrative Review Policy: It is the policy of the Department to treat every person with courtesy and respect while patrolling in a proactive manner, to aggressively investigate suspicious persons and circumstances, and to actively enforce Florida Statutes and local ordinances in ac cordance with law. Department employees shall not abuse their law enforcement powers by acting in a manner that discriminates against individuals based on race, color, ethnicity, age, background, gender, national origin, sexual orientation, gender identity /expression, economic status, culture, disability, religion or belief system, immigration status, housing status, occupation, language fluency, or any physical or personal characteristic of such individuals. [CFA 2.06M] 112.01 Bias Based Profiling: [CFA 2.06M – C] Bias based profiling is defined as the stop, detention , interdiction, search, or oth er differential treatment of any individual based on race, color, ethnicity, age, background, gender, national origin, sexual orientation, gender identity / expression, economic status, culture, disability, religion or belief system, immigration status, housing status, occupation, language fluency, or any physical or personal characteristic of such individuals. 112.02 Stop: The restraining of an individual’s liberty by physical force or their submission to a show of authority. 112.03 Detention: The ac t of stopping or restraining an individual’s freedom to leave or walk away, approaching and questioning an individual beyond a consensual encounter , or stopping an individual suspected of be ing involved in criminal activity. 112.04 Reasonable Suspicion: Reasonable suspicion is dependent upon both the content of information possessed by police and its degree of reliability. Both factors, quantity and quality, are considered in the totality of the circumstances. The suspicion is reasonable if it is based upon specific and articulable facts, and the rational inferences that may be drawn from those facts. KISSIMMEE POLICE DEPARTMENT GENERAL ORDER General Order 112 – Bias-Free Policing Page 2 of 3 112.05 Procedures: Investigative detentions , traffic contacts, arrests, searches and property seizures by employees shall be based on a standard of reasonable suspicion or probable cause in accordance with the Fourth Amendment of the U.S. Constitution. Employees must be able to articulate specific facts and circumstances that support reasonable suspicion or probable cause for investigative detent ions, traffic, contacts, arrests, searches, and property seizures. Bias-based profiling in traffic contacts, field contacts, searches, and in asset forfeitures is strictly prohibited. Race, color, ethnicity, age, background, gender, national origin, sexua l orientation, gender identity / expression, economic status, culture, disability, religion or belief system, immigration status, housing status, occupation, language fluency, or any physical or personal characteristic of such individuals or any other clas s protected by law shall not be motivating factors when initiating any law enforcement action. Additionally, these factors shall never be used as the sole basis for the initiation of police/citizen encounters. Employees may take into account the report ed race, color, ethnicity, age, background, gender, national origin, sexual orientation, gender identity / expression, economic status, culture, disability, religion or belief system, immigration status, housing status, occupation, language fluency, or any physical or personal characteristic of such individuals or any other class protected by law, of a specific suspect or suspects, based on trustworthy, relevant information that links a person or persons of a specific race, color, ethnicity, age, background , gender, national origin, sexual orientation, gender identity / expression, economic status, culture, disability, religion or belief system, immigration status, housing status, occupation, language fluency, or any physical or personal characteristic of su ch individuals or any other class protected by law, to a particular unlawful incident(s). In an effort to promote positive law enforcement interactions and to dispel perceptions of biased law enforcement, each employee shall: a. Be courteous and professional. During any interaction with the public, the only person that has a duty to be professional at all times is the employee; b. Identify themselves to the citizen by providing their name, Department affiliation, and the reason for the encounter as soon as practical. When conducting a vehicle stop, the employee shall normally provide this information before asking the driver for their license and registration; c. Ensure the detention is no longer than necessary to take appropriate law enforcement actio n and that the citizen understands the purpose of reasonable delays; d. Answer any relevant questions the citizen may have to include citation disposition procedures, court dates, etc.; e.
