ISSUE: 25-20 TRAINING BULLETIN DATE: May 2, 2025 California Senate Bill 53 Effective January 1, 2026, Senate Bill 53 will amend Penal Code 17060, Penal Code 25100, Penal Code 25105, Penal Code 25135, Penal Code 25205, Penal Code 27882, and Penal Code 27883. Senate Bill will also establish Penal Code 16745, and Penal Code 25145. In summary, Senate Bill establishes legislation requiring a person who possesses a firearm in a residence to keep the firearm securely stored when it is not carried or readily controlled, as specified. Violation of this requirement will be punishable as an infraction or misdemeanor, depending on whether it is the subject’s first or a subsequent violation. The amendment also removes exemptions to existing child access laws for individuals who have no reasonable expectation that a child is likely to be present on the premises.
