PURPOSE : The purpose of this standard operating procedure is to define the guidelines to be followed when a Sheriff's Office employee is arrested. II. SCOPE : This procedure shall apply to all Sheriff's Office employees . III. DISCUSSION : In order to afford due pr ocess, consistency , and fairness to its employees, the Sheriff's Office recognizes the importance of standardizing the guidelines to follow when a Sherif f's Office employee is arrested. IV. PROCEDURE : A. The Professional Standards Bureau supervisor sha ll be notified when an employee is arrested. * B. Personnel shall immediately notify their supervisor or, in the event they are not permitted to do so, must request their supervisor be notified by the investigating agency if they have been arrested, or if they become aware that they are the subject of an investi gation by any law enforcement agency. C. Conditions for placing an employee , who has been arrested , on suspension without pay : 1. If an employee is arrested for or charged with a felony or misde meanor, they may be placed on suspension without pay during the investigation period, including any administrative due process or appeal procedure resulting from the arrest or charge. Personnel holding the rank of Major or above are authorized to suspend a subordinate without pay. 2. When a Major or above meet s with the employee to serve them with a notice of suspension without pay, the employee may choose to make a statement to answer the allegations against him /her. This statement is strictly voluntar y. The employee may choose to remain silent and not provide any such response. No negative repercussions will result from the employee choosing to forego a response in these circumstances. 3. Employees placed on suspension without pay shall surrender al l Sheriff’s Office property, including their Sheriff’s Off ice commission card , badge, and weapon to their immediate supervisor. 4. The employee shall not work any law enforcement -related off -duty detail while on suspension without pay . The supervisor o f an employee placed on suspension without pay shall request the Hom eland Security Division, Off-Duty Events Section , to disable that employee's ABN in the Off -Duty Jobs computer program. 5. Any Major or above exercising this authority shall immediately re port in writing their action via chain of command to the S heriff , or designee. 6. If an employee is placed on suspension without pay and wishes to leave Hillsborough County, they must notify their Major, or designee , and provide an address and phone numbe r where the employee can be reached. Additional p rocedures when an employee is arrested for Driving U nder the Influence (DUI) or any criminal violation related to DUI and has refused to provide his/her breath and/or urine sample during the crimina l investigation . 1. If an employee is arrested in Hillsb orough County, and after the arresting agency has completed the criminal investigation, an administrative test of the employee’s breath and/or urine shall be conducted . a. During normal business ho urs, the employee shall be transported to the Sheriff’s Office Health and Wellness Center for testing purposes. b. After normal business hours , the employee shall be transported to the Orient Road Jail and the Medical On -site Team (MOST), shall be contacte d, and will respond to Orient Road Jail for testing purposes . MOST is the same company used by the Sheriff’s Office for after -hours drug screen collection . The phone number is (813) 924 -6678 or the backup number is (813) 924 -6675. 2. If the employee provides a breath or urine sample during the criminal investigation, an administrative test may not be necessary . * 3. It is the responsibility of the employee who has been arrested, to ensure a request is made of the investigating agency to contact the S heriff’s Office to evaluate if an administrative test of the employee’s breath and/or urine will be conducted. 4. The employee should be advised that any administrative test conducted , and the tests results , will not and cannot be used in any manner relat ed to the criminal investigation.
