PURPOSE : The purpose of this standard operating p rocedure is to define the guidelines for the use of the Hillsborough County Sheriff’s Office Trespass Authorization Form and accompanying Hillsborough County Sheriff's Office No Trespassing signs. II. SCOPE : This proce dure shall apply to all Sheriff's Office law enforcement personnel. III. DISCUSSION : The Sheriff’s Office Trespass Authorization Form and accompanying No Trespassing signs are designed to assist deputies and respective property owners who have identifie d recurring trespass problems. IV. DEFINITIONS : A. Hillsborough County Sheriff’s Office No Trespassing Sign - A Bilingual (English/Spanish) No Trespassing sign giving public notice that the Sheriff’s Office is authorized to issue and enforce trespass w arnings on said property where posted. The No Trespassing sign accompanies the Trespass Authorization Form and is posted in a conspicuous place. B. Hillsborough County Sheriff’s Office Trespass Authorization Form - A form used pursuant to Florida Statute 810.09 authorizing the Sheriff’s Office, through its duly appointed personnel, to issue and enforce trespass warnings on behalf of the owner or agent of the listed property. V. PROCEDURE : A. Per Florida Statute 810.09(3), the Sheriff’s Office Trespass A uthorization Form must be completed by the property owner or other authorized agent for the property owner. B. The following information shall be recorded accurately and legibly: 1. The complete property address including city and zip code. It may also include a business name or description , when applicable. 2. A phone number for the property owner or its agent. 3. The property owner’s or agent’s name, and circle either owner or agent as is applicable. * 4. The property owner or its agent shall initial , electronically or in writing , those areas on the Trespass Authorization Form which are applicable. * 5. The property owner or its agent shall affix their signature , electronically or in writing , to the Trespass Authorization Form with the date. 6. The d eputy’s name, ABN, and date. * 7. The district deployment zone and case number will be completed at the bottom of the Trespass A uthorization form by the online approver or patrol unit authoring the Trespass Authorization General Offense Report. * C. Deputies responding to a business complex or plaza (a location with two or more businesses contained within) f or a request of a new Trespass Authorization shall direct GEN 577.00 06/13/24 Page 2 of 3 the owner /agent to the Sheriff’s Office online Trespass Authorization request link. If the owner /agent is unable to complete the Trespass Authorization via the online link, a deputy will then complete a Trespass Authorization General Offense Report . * D. A copy of the Sheriff’s Office Trespass Authorization Form will be provided to the owner /agent upon request. The property owner /agent will then be directed to the applicable area for Sheriff’s Office No Trespassing placards . The issuance of placards will be based on the size and scope of the related property. * E. The originating deputy sha ll complete a General Offense Report utilizing the Trespass Authorization reason code. Utilizing this code will allow all Sheriff’s Office Trespass Authorization Forms to be mapped in the GIS portal, which will provide a map of all locations with signed au thorizations. * F. Deputies shall enter the property location and owner/agent as separate entities when completing the General Offense Report . * G. The original signed Sheriff’s Office Trespass Authorization Form shall be sent to records via an MRE atta chment with the transcribed General Offense Report number written on the MRE attachment form. H. The Sheriff’s Office Trespass Authorization Form information shall be entered into Versadex CAD under the “hazards” field by the respective district desk de puty. 1. Type “AZ” on the Versadex CAD command line and press enter, which will bring up the CAD Address Maintenance page. 2. The following fields must be entered: a. Category - select “T” for Trespass Authorization . b. Effective date . c. Location . d. Originator - ABN of person entering hazard . e. Radius search - select “yes.” * f. Remarks - include name of location, contact person and phone number, and the transcribed General Offense Report number. I. The authority derived from a Trespass Authori zation Form shall be utilized only in situations where a deputy encounters a potential trespasser, and the owner or agent is unavailable to issue the trespass warning. * J. Prior to a trespass warning being issued based on the authority of a Trespass Authorization Form or prior to an arrest being made without a previous trespass warning, the deputy must perceive the potential trespasser
