SUBJECT: DONATION OF PROPERTY, UNCLAIMED EVIDENCE, OBSOLETE OR SURPLUS
COMPUTER EQUIPMENT
I. PURPOSE : The purpose of this procedure is to define guidelines for the donation of
unclaimed tangible personal property and unclaimed evidence to charitable
organizations by the Hillsborough County Sheriff's Office.
II. SCOPE : This procedure shall apply to all Sheriff's Office personnel.
III. DISCUSSION : Florida State Statute 705.105 authorizes the donation of unclaimed
tangible personal property and unclaimed evidence to charitable organizations. Florida
State Statute s 274.04, 274.05 and 274.06 authorize the donation of obsolete or surplus
computer equipment to charitable organizations. The Hillsborough County Sheriff's
Office is committed to assisting these organizations, whenever possible. This
commitment is based on the belief that involvement of the Sheriff's Office in this
endeavor will be beneficial to both the community and the Sheriff's Office.
IV. PROCEDURE :
A. The requesting charitable organization must submit its request in writing to the
Sheriff. The requ est shall include a detailed listing of desired property. The
Sheriff shall review the request and may approve it, subject to review by the
Legal Section and approval of the following.
B. The Legal Section shall determine if the organization meets the re quirements of
a charitable organization under the United States Internal Revenue Code Section
501(c) (3), as amended.
C. The Evidence Section shall:
1. Ensure a copy of the organization's IRS determination letter has been
submitted.
2. Ensure a hold harm less Indemnification Agreement is signed by a legally
authorized representative of the charitable organization and submitted.
3. Determine if the requested property is or will be available to meet the
request.
a. If the property is not available, the requ esting organization will be
contacted to determine if their request is to be maintained in a file
until such time as it becomes available. At that time, the Evidence
Section will again contact the requesting organization.
b. If the property is available, and all evidence release requirements
have been complied with, the Evidence Section shall:
* (1) Forward a memo listing the items to be donated, the
signed Indemnification Agreement and reques t letter,

through the chain of command to the Chief Deputy of
Support Operations for approval.
(2) Contact the requesting organization and make
arrangements for pickup.
(3) Ensure the representative from the organization signs for
the property.
* D. The Information Services Division shall:
1. Ensure a copy of the organization's Internal Revenue Service (IRS)
determination letter has been submitted.
2. Ensure a "hold harmless" indemnification agreement is signed by a
legally a uthorized representative o f the charitable organization and
submitted.
3. Determine if the requested property is, or will be available to meet the
request.
a. If the property is not available, the requesting organization will be
contacted to determine i f their property request c an be maintained
in a file until the property becomes available. At that time, the
Information Services Division will again contact the requesting
organization.
b. If the property is available and all release requirements have b een
met, the Information S ervices Division shall:
(1) Forward a memorandum listing the items to be donated,
the signed indemnification agreement and request letter
via the chain of command to the Chief Deputy for approval.
(2) Contact the r equesting org anization and make
arrange ments for pickup.
(3) Ensure the representative from the organization signs for
receipt of the property.
