SUBJECT: TRAFFIC CAMERA ENFORCEMENT
I. PURPOSE : The purpose of th is standard operating procedure is to define guidelines for the
enforcement of traffic infractions detected via image capture technology in order to increase
motorist compliance and safety within Hillsborough County.
* II. SCOPE : The County has chosen t o utilize image capture technologies as a supplemental
means of monitoring compliance of Florida Statute 316.075( 1)(c)1, 316.172 (1)(a) ,
316.172(1)(b), and 316. 1895 (10), while assisting law enforcement personnel in the enforcement
of this law. Sworn law en forcement personnel shall review recorded images prior to the
issuance of a Notice of Violation to ensure the accuracy and integrity of the recorded images.
This written directive shall apply to a ll agency personnel when operating any Sheriff’s Office
owned vehicle.
* III. DISCUSSION : Hillsborough County is a high-density traffic area which regularly experiences
traffic crashes directly related to the failure of motorists to obey duly erected traffic control
devices, thereby exposing citizens to the dang ers of personal injury and property damage.
Florida Statute 316.008 3(1)(a) and 316. 173, authorizes a county or municipality to use traffic
infraction detectors to enforce Florida Statute 316.075(1 )(c)1 or 316.074(1) . The Sheriff’s Office
as a public safe ty agency utilizes this technology to enhance traffic enforcement and promote
lawful compliance to protect the health, safety , and welfare of the citizens.
IV. DEFINITIONS :
A. Intersection - The area embraced within the prolongation or connection of the lateral
curbline or ; if none, then the lateral boundary lines of the roadways of two roads which
join or intersect one another at, or approximately at, right angles or ; the area within
which vehicles traveling upon different roads joining at any other angle may come in
conflict. Where a highway includes two roadways 30 feet or more apart, then every
crossing of each roadway of such divided highway by an intersecting highway shall be
regarded as a separate intersection. In the event such intersecting highway also
includes two roadways 30 feet or more apart, then every crossing of two roadways of
such highways shall be regarded as a separate intersection.
B. Motor Vehicle - Any self -propelled vehicle not operated upon rails or guideway, but not
includi ng any bicycle, motorized scooter, electric personal assisted mobility device, or
moped.
C. Notice of Violation - An initial notice issued for a traffic infraction.
D. Owner/Vehicle Owner - The person or entity identified by the Florida Department of
Highway Safety and Motor Vehicles (DHSMV), or other state vehicle registration office,
as the registered owner of the vehicle. Such term shall also mean a lessee of a motor
vehicle pursuant to a lease of six months or more.

E. Recorded Images - Images rec orded by a traffic infraction detector to include: two or
more photographs, electronic images, digital images, video , or any other medium. At
least one of such images must show the rear of the motor vehicle, clearly identifying the
license tag of the veh icle.
F. Red Light Infraction - An offense of Florida Statute 316.075 (1)(c)1 or 316.074(1)
whereby a traffic infraction detector established that a vehicle entered an intersection
controlled by a duly erected traffic control device at a time when the traf fic control signal
for such vehicle’s direction of travel was emitting a steady red signal.
* G. School Bus Stop Arm - An extended stop arm (stop sign) with red flashing lights
indicating that the school bus has stopped and children are boarding or exiti ng.
* H. School Bus Stop Arm Infraction - An offense of Florida Statute 316.172(1)(a) or
316.172(1)(b) whereby a traffic infraction detector established that a vehicle failed to
make a full stop and proceeded to pass a school bus with the bus arm extended and/or
the stop signal was displayed.
* I. School Zone - An area near a public or private school that has school zone signs,
markers, traffic control devices, and pedestrian control devices. The designated zones
shall have flashing yellow lights before , during, and after the ingress and egress of the
regularly scheduled school session. The school zone speed limit may not be less than
15 miles per hour except by local regulations and shall not be more than 20 miles per
hour.
* J. Speed Zone Infraction - An offense of Florida Statute 316.183(2) or 316.1895(10)
pursuant to Florida Statute 316.1896 whereby a traffic infraction detector established
that a vehicle entered a school zone controlled by a duly erected traffic control device at
a time when the s chool zone traffic control device was emitting a flashing yellow signal
and the vehicle exceeded the posted school zone speed limit.
