PURPOSE : The purpo se of this standard operating procedure is to provide guidelines for secure temporary detention rooms at the Sheriff's Office. II. SCOPE : This procedure shall apply to all law enforcement Sheriff's Office personnel. III. DISCUSSION : Sheriff's Office de puties/detectives often need to interview persons under arrest and prepare paperwork prior to transporting and booking these persons at a detention facility. Secure temporary detention rooms within the Sheriff's Office provide a place for temporary detent ion. This procedure defines guidelines for the use of secure temporary detention rooms to ensure the safety of all Sheriff's Office personnel, as well as the person being detained. IV. DEFINITIONS : A. Detainee - A person held or detained in legal custody i n a secure temporary detention room for processing or q uestioning after an arrest, prior to being transpo rted to a detention facility. * B. Secure Temporary Detention Room - Any room or area under control of the Sheriff's Office designated for secure and temporary detention of a detainee which shall be equipped with a bench , have adequate lighting as required by local code or ordinance, and circulation of fresh or purified air in accordance with local public health standards. The secure temporary detenti on room shall : 1. Afford the deputy/detective the oppo rtunity to interview the detainee. 2. Provide a secure area to temporarily detain a person who has been arrested while the deputy/detective prepares the necessary paperwork, prior to transporting the d etainee for boo king at a detention facility. C. Transport Restraints - A pair of handcuffs and a pair of leg irons attached to each other by a single chain. These are u sed primarily for transport but can also be utilized on non-compliant prisoners. V. PROCEDURE : A. Sheriff's deputies/detectives detaining persons in secure temporary detention rooms within Sheriff's Office facilities shall be trained on the procedures to ensure the safety of all Sheriff's Office personnel, as well as the person being det ained, by following these procedures: 1. The deputy/detective shall search the secure temporary detention room for contraband/weapons prior to a detainee(s) being placed in the room. The room shall also be searched for contraband/weapons after removing t he detainee(s) from the room. 2. Each detainee shall be searched for weapons or contraband prior to placing him/her in the secure temporary detention room. All property/contraband shall be removed from the detainee's person and secured. GEN 505.06 10/18 /22 Page 2 of 3 3. Consideration s hall be given to safety of Sheriff's Office personnel, as well as the detainee, and measures taken to prevent escape of the detainee: a. Secure temporary detention room doors shall be locked after placing a detainee in the r oom. b. The decision to have t he detainee handcuffed and/or shackled or secured in transport restraint s while in the secure temporary detention room shall be at the discretion of the deputy/detective. c. Detainees shall not be handcuffed or otherwise secured to any fixed objects within the room. d. Deputies/ detectives , who enter the secure temporary detention room armed , shall use caution in exposing firearms or weapons in close proximity of a detainee. e. Only personnel who have been given permission by the deputy/detective , are allowe d in the secure temporary detention room with a detaine e. Civilian personnel shall not be allowed in the secure temporary detention room, unless under direct supervision of law enforcement personnel. * 4. The deputy/detective shall complete the Temporary Detention Log for both adult and juvenile detainees ; and t he Florida JJDPA (Juvenile Justice and Delinquency Prevention Act) Compliance Monitoring Form must be completed for all juvenile detai nees. Completed forms are then provided to the administrative desk deputy. 5. A person may be temporarily detained in a secure temporary detention room; however, the person(s) may not be detained for more than two hours without continuous control or supe rvision by agency personnel. * 6. When a detainee is not under continuous control or supervision by agency personnel, the detainee shall be checked on at least every 15 minu tes and shall be monitored via audio and video surveillance by the administrative desk deputy. 7. If the detainee is suicidal, there shall be con tinuous visu al observation of the detainee. 8. Male and female detainees shall not be detained in the same secure temporary detention room. 9. Adult and juvenile detainees shall not be detained in the same secure temporary detention room. * 10. A deputy/de tective shall maintain constant supervision of detainees not contained in a secured temporary detention area. * 11. Detainees shall be allowed access to water , restroom s, and other needs in a timely manner
