TOM DaRé , CHIEF OF POLICE Professional Standards Division NUMBER: 2022 -06 ISSUED: June 7 , 2022 Consent for Disposal of Firearms, Ammunition, and Ammunition Feeding Device(s) Form The Garden Grove Police Department has developed a “Consent for Disposal of Firearms, Ammunition, and Ammunition Feedi ng Device(s)” form that can be completed by a Sworn O fficer, CSO, and front desk personnel . This can be done during a call for service or when citizens come into the front desk to turn in firearm (s), ammunition, or ammunition feeding device (s) to be destroyed. This form assists Property and Evidence by allowing them to destroy the firearm(s), ammunition, and/or ammunition feeding device(s) immediately. The following is the process that Sworn Officers, CSO’s, and front desk personnel will take when taking custody of the firearms: 1. Conduct a records check on the firearm (s) to ensure it is not stolen or has been used in a crime . 2. If the firearm is listed as a stolen gun or crime gun, an Officer will conduct an investigation and complete a rep ort. T his form will not be used . 3. Once the department personnel have completed a records check , the manufacturer/make, model, caliber, and serial number need to be listed on the form under “Firearm(s)” . 4. If department personnel take custody of any ammunition or am munition feeding devices, the brand, type/caliber, and amount will be listed on the form under “Ammunition and/or Ammunition Feeding Device(s)” . 5. If a citizen ha s more than five firearms or more than three different types of ammunition or ammunition feeding devices, additional forms need to be completed . 6. Once the firearm(s), ammunition, and/or ammunition feeding device(s) are listed on the form, the citizen will print their name on the top line and sign and date the signature line above the firearm (s) information . 7. Department personnel will print, sign, and date their name under “Acknowledgement of the Garden Grove Police Department” . 8. Once the form is signed and completed, department personnel will scan and attach the form under “files” on the assigned incident number . In addition to completing the form, department personnel need to complete an O fficer’s report on how the citizen obtained possession of the firearm(s), ammunition, and/or ammunition feeding device(s). While taking these reports, the Officer, CSO, or front desk personnel need to document any important information as to how the reporting party took possession of the items. The reporting party ’s personal identifying information needs to be added to the report . If the reporting party obtai ned the firearm(s) from a relative who is now deceased , the O fficer, CSO, or front desk personnel need to obtain the relative’s personal identifying information and add it to the report. I, ___________________ ____________________ , without admitting or acknowledging any past or current criminal (Printed Name of Firearm Owner/Possessor) conduct relating to the firearm(s), ammunition, or ammunition feeding device(s) listed below, hereby certify that I own or possess the firearm(s), ammunition, or ammunition feeding device(s) and have the sole right to exercise custody and control over the firearm(s), ammunition, or ammunition feeding device(s). By signing this form, I waive any right to request the return of the listed firearm(s), ammunition, or ammunition feeding device(s) from the Garden Grove Police Department, pursuant to Penal Code section 33850 et. seq., and agree that the Garden Grove Police Department may destroy the listed firearm(s), ammunition, or ammunition feeding device(s) without further notice. If any of the listed firearm(s), ammunition, or ammunition feeding device(s) have been reported lost or stolen by another individual, I understand that the Garden Grove Police Department will notify t he individual who reported the firearm(s), ammunition, or ammunition feeding device(s) lost or stolen and will return the firearm(s), ammunition, or ammunition feeding device(s) to that individual upon compliance with Penal Code section 33855. I hereby ag ree to hold the Garden Grove Police Department harmless regarding the disposition of the listed firearm(s), ammunition, and ammunition feeding device(s).
