TOM DaRé , CHIEF OF POLICE Professional Standards Division NUMBER: 2021 -13 ISSUED: November 18 , 2021 Deadly Drug Advisement The City of Garden Grove, as well as, the County of Orange have been experiencing an influx of fatal drug overdoses, specifically related to Opioid drugs. All illegal drugs and counterfeit pills are themselves deadly because they are often mixed with Fentanyl or a derivative of Fentanyl. These substances alone or mixed together can be fatal even in very small doses. The Garden Grove Police Department has developed a “Deadly Dru g Advisement” form that shall be given to drug dealers to warn them that the drugs they are selling are dangerous to human life. This advisement may later be used to prove in court that the drug dealer had been formally advised that the drugs they chose to sell are a danger to human life. When officers or detectives make an arrest of any subject for the sales of any type of controlled substance, they shall issue the suspect the “Deadly Drug Advisement” advisement. This advisement is available in the report writing room and at the records counter. The original shall be scanned, uploaded into the P drive under “Deadly Drug Advisements” and then booked into Property and Evidence. A copy of the original should also be scanned and attached to the report. The yellow copy is to be provided to the suspect after the advisement has been given. The officer or detective should record this process on Body Worn Camera for proper documentation or any other device that can archive the audio portion and document the action in the report. The Advisement has a signature line for the arrestee to sign, acknowledging he received the notice. The signature is voluntary on the subject’s part. Any refusal to sign should be noted on the signature line and documented in the report. See attached advisement. Selling, furnishing, or distributing drugs to those who intend to use them has the potential to cause serious bodily harm or death as they are often mixed with deadly substances such as fentanyl or analogs of fentanyl. Fentanyl is a powerful synthetic opioid and can kill human beings even in very small doses. Therefore, if you sell, furnish, or distribute drugs to someone, and that person dies as a result of using the drugs, you can b e charged with murder. This advisement is only to place you on notice about the dangers of selling, furnishing or distributing drugs to someone. This advisement is not an admission of guilt.
