I. PURPOSE: The purpose of this Order is to establish guidelines and procedures regarding
agency jurisdiction and concurrent jurisdiction.
II. POLICY: To protect the public peace and safety and to preserve the life and property of the
citizenry, the Gainesville Police Department (GPD) shall, when deemed necessary, establish,
maintain, and implement concurrent jurisdiction policies or agreements with other governing
agencies.
III. DEFINITION:
Concurrent Jurisdiction: Concurrent jurisdiction is defined as the geographical area over
which the Gainesville Police Department and another law enforcement agency both have police
authority.
IV. PROCEDURE: [CALEA 2.1.2]
A. Jurisdiction: The jurisdiction of the Gainesville Police Department lies within the
geographical boundaries of the city of Gainesville, Alachua County, Florida which are defined
in the Gainesville Code of Ordinances and illustrated on the accompanying map of the city of
Gainesville located on the GPD Intranet. [CALEA 2.1.1]
B. Inter-Jurisdictional Crimes: Because portions of a crime can occur across jurisdictions,
the investigation of a criminal act often requires the involvement of more than one law
enforcement agency.
1. Crimes initiated outside Gainesville: When an offense occurs outside Gainesville and
the victim is carried into the city, the Department is responsible for only that portion of the
investigation relating to its jurisdiction.
If requested by the agency in whose jurisdiction the offense began, the Department shall
courteously render assistance and coordinate its investigative effort with the requesting
agency.
2. Crimes initiated inside Gainesville: When an offense occurs inside the city and the
victim is carried outside, the Department shall extend its investigation, coordinating its efforts
with any other agency into whose jurisdiction the offense was extended.\n\n--- Page 2 ---\n\nGAINESVILLE POLICE DEPARTMENT
C. Veteran’s Administration Medical Center:
1. Concurrent Jurisdiction: The Gainesville Police Department has concurrent jurisdiction
with the Veteran’s Administration Medical Center (VA), both inside the buildings and on the
outside grounds of the complex.
2. Law Enforcement Responsibility:
i. V.A. Police: The Department of Veteran’s Administration Police will have primary
responsibility for handling most incidents at the Medical Center.
ii. GPD: The GPD shall respond when requested by the VA.
Upon request from the VA, GPD may provide assistance to the VA including, but
may not be limited to the following situations where your department's assistance
would be required:
a. Armed hostage taking situations that would require an armed response to
assist VA Police in containing the situation until appropriate Federal agencies
(such as the Federal Bureau of Investigation - FBI) can respond to assume
control.
b. Crimes involving armed robberies of funds, drugs, or properties where the
individuals committing the crimes leave VA police jurisdiction.
c. Vehicle accident investigations, which may result in non-injuries, injuries, or
death involving the VA Police patrol vehicle.
d. Any major incident that would require additional officers for traffic control to
allow emergency vehicles a clear access to the facility.
e. To assist confirming the identification of wanted subjects, arrest and/or
detain individuals who have outstanding warrants issued for their arrest by civil
law enforcement agencies. VA Police would execute the detention and physical
arrest of subjects under Federal warrants.
f. To provide additional officers when needed to assist with the physical arrest
of a violent/disorderly person(s) who poses a serious threat to patients, visitors,
medical staff, or themselves.
g. Provide assistance in the transportation of prisoner's who have been
arrested at the on occasions when they are only two VA police officers on-duty.
h. Should any VA Police Officer be involved in a shooting, the FBI will be
notified immediately. If the FBI declines investigation, or if the FBI response is
delayed, this agreement establishes inter-agency support for the VA Police to
receive investigative assistance from the Gainesville Police Department. This
assistance may range from establishing, preserving and/or controlling
iii. Violent Subjects: A field supervisor and two members will be dispatched when the
incident involves a violent or potentially violent subject.

iv. Weapons: Members will not remove their weapons when responding to calls inside
the facility:
Situations in which the introduction of a weapon to a patient-care area is considered
dangerous shall be determined by the proper hospital authorities.
When a danger exists, and when possible, patients shall be escorted from the area by
VA medical or VA police personnel.
v. Access to Patient: If approved by medical staff, members may question a patient,
take photographs, collect evidence and, when appropriate, be present in the treatment
room.
If direct access is not possible, GPD personnel will ask VA staff to assist in the collection
of evidence.
Incidents where a Department member is refused access to an individual should be
noted in the member’s report.
vi. Interviewing A Patient: The VA Medical Center’s attending medical staff will advise
law enforcement officers of the possibility of harm to a patient if the patient is subjected
to questioning or removal from a health care program.
vii. Medical Information:
1) Medical Records: Information regarding the medical records of a patient is
privileged and not available except by court order.
2) Medical Information: If an incident involves a patient, the VA Police and
medical staff will assist Department members with any clinical information or
assistance which may be relevant to the incident.
The VA’s Clinical Information Liaison is accessible 24 hours a day, by request,
for members who need information about a patient in crisis.
viii. Crisis Response Team: Members may request the following response, when
needed:
1) Inside the Facility: The VA Medical Center’s ‘Management of Disturbed
Behavior’ Response Team (Crisis Team).
2) Outside the Facility: The Alachua County Crisis Center Team.
ix. Transportation for Baker /Marchman Act Patients: The VA police will provide
transportation regarding routine cases that fall under the purview of a Baker Act
(mentally ill) or Marchman Act (substance abuse).
x. Subjects Involved in GPD Use of Force: Members may use the VA Hospital to
provide medical evaluations and treatments for those subjects who may be injured
because of a use of force by GPD.
D. Downtown Federal Building / General Services Administration (GSA), 401 SE 1 Ave.:

1. Extension of Jurisdiction: The GSA has, by agreement, extended the jurisdiction of the
Gainesville Police Department to the property of the federal building located at 401 SE 1
Ave.
2. Requests for Service: The GSA shall determine its need for police service.
3. GPD Response: GPD shall respond when requested by GSA.
Examples of incidents for which GPD may be requested include those involving serious
criminal violations, threats of violence, or trespasses which interfere with normal operations
at the facility.
This does not prohibit members from taking appropriate action when violations are observed
or when members are alerted that an immediate response is indicated.
4. Incident Control: GPD members shall be under the authority of GPD supervisors.
