PURPOSE: This Order establishes Departmental guidelines for officers assigned to the University of Florida Licensing Detail. II. POLICY: The Department will maintain a close working relationship with the University of Florida in an effort to enforce laws regarding the forging, counterfeiting, selling, or possessing unlicensed University of Florida merchandise. III. PROCEDURE: A. Direction and Supervision: Assigned members, although working in conjunction with the University of Florida Athletic Association staff, shall act as a Gainesville Police officer. 1. Officers who observe a possible violation, but who are not specifically assigned to the UF Licensing Detail/representative, shall not take any arrest action until they confirm that the items in question are not licensed. 2. Members may contact the University of Florida Athletic Association to obtain information regarding which vendors/items are licensed B. Jurisdictional Authority: Assigned officers have enforcement authority within the City of Gainesville and on the University of Florida Campus. C. Assignment Attire: The licensing assignment is a non-uniform, plain-clothes detail. Casual dress is authorized as long as it presents a professional image. D. Pro-Arrest Policy: Officers are expected to make the appropriate arrest (physical arrest, NTA, or sworn complaint) when they have probable cause to believe that a subject has committed a licensing violation. 1. Forging/Counterfeiting Private Labels; Possession of Reproduction Materials (F.S. 831.03): Whoever knowingly and willfully forges or counterfeits the trademark or service mark of any person, entity, or association, which goods or services are\n\n--- Page 2 ---\n\nGAINESVILLE POLICE DEPARTMENT intended for resale, or possesses tools or other reproduction materials used for the reproduction of specific forged or counterfeit trademarks or service marks, is guilty of counterfeiting. 2. Vending Goods or Services with Counterfeit Trademarks or Service Marks (F.S. 831.05): Whoever knowingly sells or offers for sale, or purchases and keeps or has in his/her possession with intent that the same shall be sold, or vends any goods having a forged or counterfeit trademark of any person, entity, or association, knowing the same to be forged or counterfeited, is guilty of selling or offering for sale counterfeit goods or services. 3. Statutory Penalties: i. Specific Charge(s): The member shall refer to the current Florida State Statute for the most appropriate charge(s). ii. General Guidelines: a Misdemeanor: Goods described in III, D, 1 and III, D, 2 above which have a value of less than $1,000. b Felony: Goods described in III, D, 1 and III, D, 2 above which have a value of $1,000 or more. E. Disposition of Evidence and Property: The following guidelines shall be used when any property or evidence is seized pursuant to a licensing violation: 1. Evidence: 2. A representative sample (one item) of each type of property seized as evidence will be: i. Properly tagged, documented, and placed into evidence at the Gainesville Police Department. ii. The remaining items will be inventoried and given to the University of Florida Athletic Association to be held pending court disposition. 3. Forfeiture: Any item employed as an instrumentality in the commission of a licensing violation is subject to forfeiture proceedings. (Refer to G.O. 40.20 for the proper procedures for seizing property for forfeiture.) F. Incident Reporting: Incidents involving a licensing violation shall be documented on a Department Investigative Report. The report will include: 1. Disposition of all property (inventoried, seized, turned over to UF, placed into evidence, held for forfeiture, etc.) 3.
