PURPOSE: This Order establishes guidelines regarding juvenile escapees. II. POLICY: The Gainesville Police Department shall take into custody juvenile escapees and return them to the proper detention facility. III. PROCEDURE: A. Escape: 1. Juvenile Facility: A Department member who investigates an alleged escape from a juvenile detention or residential facility of restrictive level VI (half-way house) or above shall: i. Complete and submit an Investigative Report, ii. Complete and submit an arrest mittimus for escape from a juvenile facility, iii. Issue a BOLO for the escapee, iv. Complete FCIC/NCIC entry request and forward it to Records via MCT for entry. The investigative report shall include the NIC number and Records Division personnel name and ID number. The investigating member shall code the juvenile as a runaway and indicate in the remarks section that the juvenile escaped from a court-ordered detention facility. 2. Furlough: If any delinquent child committed to the Department of Juvenile Justice (DJJ) escapes or fails to return to a juvenile facility while on furlough, it shall be considered an escape from the facility to which the child was committed. Members will follow the procedures outlined for escaped juveniles. 3. Interface: Interface is not a secure detention facility, thus the procedures for escapees shall not be used for incidents of runaways from Interface.\n\n--- Page 2 ---\n\nGAINESVILLE POLICE DEPARTMENT B. Regaining Official Custody: 1. Clarification: Members will consider a child to be in official custody if that child has been detained by or turned over to law enforcement. Members who receive information that does not indicate an official custodial situation, (such as a child is with a family member) shall complete a supplemental report detailing the information, and who provided it, but shall not consider the child recovered for the purposes of clearing the report, the charge, or the computer entry. Substantial information shall be turned over to the jurisdictional law enforcement agency as soon as possible to target the apprehension of the juvenile. 2. Inside Jurisdiction: Sworn members who locate a child who has escaped from a DJJ facility shall: i. Take the child into custody, ii. Complete and submit an Investigative Report or supplement to the original report, iv. Complete FCIC/NCIC exit request and forward it to Records via MCT for exit. The investigative report shall include the NIC number and Records Division personnel name and ID number. v. Deliver the child to the appropriate DJJ personnel and a. Complete an arrest mittimus, if the pick-up order has not yet been processed, b. If a pick-up order has been issued, DJJ personnel will notify the ACSO to respond and serve the order. c. Pick-up orders addressed to all law enforcement agencies may be executed by police officers. vi. Cancel the BOLO 3. Outside Jurisdiction: If a juvenile who escapes from Gainesville is taken into custody outside of Alachua County and the juvenile cannot be immediately turned over to the GPD due to the location of the arrest, the arrest information shall be forwarded to the front desk officer who will: i. Verify the location of the child, via a teletype, and that the child is being securely 2\n\n--- Page 3 ---\n\nGAINESVILLE POLICE DEPARTMENT detained while awaiting DJJ transport. Request that the arresting agency take the child’s fingerprints and photographs. This would assist in verifying the identity of the child, if needed. ii. Complete a supplement report, to include: a. Circumstances under which the child was taken into custody, including additional charges, if applicable. b. Copies of the detaining agency’s reports, if available. If not immediately available, cite the case number, at a minimum. c. Copies of all related teletypes. d. Complete FCIC/NCIC exit request and forward it to Records via MCT for entry. The supplement report shall include the NIC number and Records Division personnel name and ID number. 1) First run an FCIC/NCIC check to obtain a copy of the information on the computer ‘hit’ for the child. Include the information in the supplement report. iii. Notify DJJ personnel of the arrest and where the child is being held, a) Depending upon the hour, contact JAC or JDC. Identify in the supplemental report the staff member to whom the notification was made. b) Generally, DJJ will be responsible for retrieving the child. iv. Cancel any existing BOLOs 4. Assisting Department of Juvenile Justice: Because circumstances may arise which are not covered in this order, members, if requested, will assist DJJ when an escaped juvenile who has been returned to our jurisdiction needs further processing. _________________________ By Order of Signed Original on File in The Accreditation Unit __________________________ Tony R.
