Policy 515Fremont Police Department Parking Compliance Specialist and Parking Compliance Officer Citation Guidelines 515.1 PURPOSE To ensure uniformity in the issuance of parking citations by personnel assigned duties of the Parking Compliance Specialist and Parking Compliance Officer. 515.2 PERSONNEL Parking Compliance Specialist: The Parking Compliance Specialist assists with providing daily direction and developing parking compliance strategies. Responds to complaints from the public regarding parking enforcement activities and performs other related duties as listed: (a)Plans, organizes, assigns, directs and reviews the work of Parking Compliance Officers; (b)Trains staff in work procedures, offers guidance on parking related matters and ensures work aligns with City objectives; (c)Responds to difficult business, school and resident inquiries and concerns via telephone, email and in writing; (d)When assigned and appropriate, represents the City at a variety of meetings; and serves as a liaison to other city departments, community groups, elected and appointed officials, other public agencies, committees, consultants, private enterprises and the general public on the City’s behalf; (e)Investigates complaints received regarding parking enforcement activities, including performing field observation of conditions; (f)Assists in the coordination of parking arrangements for special events; (g)Coordinates equipment maintenance and requisitions related to vehicles, computers and other items used for parking/traffic control functions; (h)Directs the analysis of data and develops recommendations for improvements to the enforcement function; (i)Identifies and understands issues, problems, and opportunities; uses effective approaches for choosing a course of action or developing appropriate solutions; (j)Communicates and listens effectively and responds in a timely, effective, positive and respectful manner; (k)Prepares written reports and correspondence that are accurate, complete, current, well-organized, legible, concise, neat, and in proper grammatical form responds to statements and comments of others in a way that reflects understanding of the content; asks clarifying questions to assure understanding of what the speaker intended, and ensures consistent communication takes place within area of responsibility. Published with permission by Fremont Police DepartmentParking Compliance Specialist and Parking Compliance Officer Citation Guidelines - 1 Fremont Police Department Parking Compliance Specialist and Parking Compliance Officer Citation Guidelines Parking Compliance Officer: The Parking Compliance Officer patrols citywide streets, parking facilities and other off-street locations to enforce City of Fremont Municipal Codes and California Vehicle Codes; areas of assignment include, but are not limited to, Downtown, City owned and/or operated surface lots, commercial, business, schools, and residential areas. Investigates citizen parking complaints, observes and reports unauthorized activities, hazards, and other conditions or emergencies. Assists with Traffic Control for citywide special events. Issues warning notices and/or citations and implements towing for violations. Performs other related duties as describe: (a)Explains parking and traffic regulations to the public. Provides information in response to questions about citations, towed vehicles, route of travel, points of interest, directions, and related matters to the public. (b)Issues warnings, as appropriate and orders towing of vehicles for certain parking violations, abandoned/unused vehicles, and for construction, street repair, tree- trimming, or other projects; completes necessary records and vehicle inventory forms for all vehicles towed and notifies appropriate enforcement personnel. (c)Observes, inspects and reports conditions such as hazards, traffic obstructions, accidents, stolen cars, city property damage, needed repairs to city property or equipment, vandalism, and any unauthorized or unlawful activities or emergency situations. (d)Answers a wide variety of questions from the public and responds to complaints regarding abandoned vehicles, parking and related traffic laws, location of public buildings, parks and points of interest, bus lines, other general directions, etc. 515.3 POLICY (a)Parking Compliance Officer (PCO's) are empowered to issue warnings and/or citations to parked vehicles for non-moving violations of the California Vehicle Code (CVC) and Fremont Municipal Code (FMC) 1.PCO's are not empowered to issue citations to drivers or other persons. 2.In such an instance that mandates a citation be given to a person, the PCO shall request a sworn officer to the location. The sworn officer will then make the final determination and issue a citation as he/she deems appropriate. (b)Violations and Parking Regulations 1.PCO's should issue citations to parked vehicles that are in violation of the CVC and/or FMC sections. 2.When a type of violation is enforceable by both a CVC and a FMC section, the FMC section should be used,e.g., handicapped zones. 3.A vehicle, which is in violation of more than one parking regulation, should usually only be cited for on section at a time. Again, the vehicle should be cited for only one parking violation on the subsequent occasion.
