Policy 514Fremont Police Department Photo Enforcement Red Light Program (PERLP) 514.1 PURPOSE AND SCOPE The purpose of this policy is to establish the Department policy and procedure for overall operations of the City of Fremont's Photo Enforcement Red Light Program (PERLP). The Photo Enforcement Red Light Program (PERLP) is designed to supplement conventional law enforcement efforts to reduce vehicular collisions and red light violations at selected intersections by accurately identifying red light violations on a 24-hour basis. Incidents are then reviewed and verified by designated Fremont Police staff prior to any citations being issued. This policy provides procedures for utilizing photo enforcement red light camera systems in the City of Fremont in accordance with and under authority of sections 21455.5 through 21455.7 of the California Vehicle Code (Division 11, Chapter 2, Article 3). 514.2 BACKGROUND Management of daily operations and administrative functions of the Photo Enforcement Red Light Program shall be the responsibility of the Lieutenant assigned to the Traffic Unit. PERLP Staff shall be designated by the Chief of Police and shall be supervised by the Traffic Lieutenant. The Fremont Police Department contracts with Reflex Traffic Systems, Inc. (Redflex) to provide equipment, maintenance, and data processing of potential red light violations at intersections designated by the Fremont Police Department. Redflex sends data to the Fremont Police Department via a secure web server, utilizing proprietary software pursuant to the contract between the City and Redflex. The Fremont Police Department manages the PERLP program in its entirety, and is the sole entity with authority to issue automated red-light enforcement citations. 514.3 PHOTO ENFORCEMENT CAMERA LOCATION SELECTION Notwithstanding the statutory requirements of the enabling legislation, the decision to place an automated enforcement system at a particular intersection/approach is the sole discretion of the Fremont City Council. In evaluating an intersection/approach for installation of an automated photo enforcement system, the following factors may be considered: (a)The intersection design lends itself to installation of a camera system. (b)The overall width of the roadway permits curbside or center island mounting of the camera equipment. (c)Adequate City owned curbside property at the intersection is available to locate camera equipment and a control cabinet (if needed). Copyright Lexipol, LLC 2023/10/02, All Rights Reserved. (e)The yellow timing phase is consistent with or greater than the minimum requirements of the California Vehicle Code Section 21455.7, in accordance with the Traffic Manual by the California Department of Transportation. (f)Citizen complaints of red light running. (g)Proximity of school zones. (h)Proximity of senior housing. (i)Pedestrian and traffic flow. (j)Police Department recommendations. 514.4 PERLP IMPLEMENTATION PROCESS (a)Once the City Council has designated a new intersection to be part of the PERLP, the procedure listed below will be followed. (b)Intersections equipped with red light photo enforcement camera systems will be properly posted as defined by section 21455.5(a)(1) in the California Vehicle Code, with signs posted within 200 feet of an intersection where a system is operating. Additionally, signs will also be posted at all majors entrances into the City of Fremont. (c)A 30-day "warning period" shall commence with the activation of any new intersections; during which period the violator at the new intersection will receive a warning letter, rather than a citation. (d)Each new intersection chosen for inclusion shall cause a press release to be issued by the Traffic Lieutenant, which shall include the following information: 1.Name of the intersection. 2.Date the intersection will begin photo enforcement operation. 3.First day (date) and last day (date) of warning period. 4.Date (day) the enforcement period becomes effective with citations to be issued. 514.5 PERLP PROGRAM STAFF Lieutenant : Supervises the PERLP staff and oversees the overall operations of the program as well as ensures program staff is trained in order to conduct day to day operations. Published with permission by Fremont Police DepartmentPhoto Enforcement Red Light Program (PERLP) - 2 Fremont Police Department Photo Enforcement Red Light Program (PERLP) Authorized by the Chief of Police and trained to review incident activations, verify red light violations captured by the automated red light cameras, and conduct the day to day operations of the program. Training is provided by current PERLP staff. Patrol Officer Responsibility : Authorized to use discretion to issue or take any other enforcement action, when appropriate, including issuing a citationl for violations of California Vehicle Code Sections 21453(a) or 21453(c) as deemed necessary. However, the Officer should e-mail the PERLP Staff and Traffic Lieutenant with the citation number and explanation within 24-hours of issuing the citation to ensure that the red light staff does not issue a second citation. 514.6 PROGRAM RESPONSIBILITIES PERLP staff is primarily responsible for reviewing and verifying all red light camera enforcement activations to determine whether there is a preponderance of evidence that a traffic violation has occurred.
