Policy 352Fremont Police Department Work-Related Fatalities & Serious Injuries (Non-Employee) 352.1 PURPOSE AND SCOPE In order to comply with the requirements of the California Labor Code Section 6409.2 and California Administrative Code, Title 8, Section 342(b) & (c) members of this department will follow guidelines established under labor codes. Whenever a Police Department employee is called to the scene of an accident where an employee (any person hired by another to work for wages) has become seriously ill or injured, or if death occurs, the Police Department employee shall immediately notify the Division of Occupational Safety & Health at (510) 622-2916. If circumstances so indicate, the employee should initiate an investigation. 352.2 PROCEDURES Whenever a Police Officer or Community Service Officer is called to the scene of a work-related accident where an employee (any person hired by another to work for wages) has become seriously ill or injured, or if death occurs, the officer or Community Service Officer will notify the Division of Occupational Safety & Health. (a)In cases where both the Fire Department and the Police Department are at the scene of an industrial accident, it will be the Police Department's responsibility to notify the Division of Occupational Safety & Health at (510) 622-2916. (b)When reporting an accident to the Division of Occupational Safety & Health, the person reporting will be required to supply the following information: 1.Time and date of accident. 2.Employee's name, address, and telephone number. 3.Name and job title, or badge number of person reporting accident. 4.Address of site of accident. 5.Name of person to contact at site of accident. 6.Name and address of injured employee(s). 7.Nature of injury. 8.Location where injured employee(s) was (were) moved to. 9.List and identity of other law enforcement agencies present at site of the accident. 10.Description of the accident and whether the accident scene has been altered. Serious injury or illness or death does not include any injury, illness, or death caused by the commission of a Penal Code violation, except a violation of Penal Code Section 385.
