346Fremont Police Department
Solicitors and Peddlers
346.1 PURPOSE AND SCOPE
All profit-making solicitors/peddlers will be processed and licensed before conducting business
within the City of Fremont. Staff will work with other departments of the city to ensure enforcement
of violations when appropriate. The purpose of this policy is to designate responsibility for issuance
of permits and enforcement of local ordinances.
346.2 PROCEDURES
The following is a chronological outline of the procedure for permit applicants and the department
responsible for each step.
(a)Initial contact will be handled by the Revenue and Treasury Division of the City Office
of Financial Services. Revenue and Treasury Division will be responsible for:
1.Providing the citizen with FPD Form #1456, Permit Application Information Sheet
(sample attached), and the Business Tax Registration Application Form.
2.Providing the applicant with the applicable codes and laws dealing with soliciting
and peddling.
3.Collecting all city fees, including the fingerprinting fees.
4.Referring the applicant to the Police Department for further processing.
5.Issuing and laminating the permit after processing and approval by the Police
Department.
6.Maintaining files of approved and disapproved permits.
(b)The police department through the Community Engagement Unit will be responsible
for the following:
1.The Police Records Specialist of the Community Engagement Unit will forward
the fingerprint cards to CII/DOJ for a criminal history check.
2.The file will be maintained in Community Engagement Unit until the criminal
history is received from CII/DOJ.
3.When the criminal history is received from CII/DOJ, the file will be forwarded to
the Special Investigator for review.
4.If not approved, the Special Investigator will notify the applicant by letter that the
application for a solicitor/peddler permit has not been approved.
5.The Police Records Specialist will then send the entire applicant packet, whether
approved or disapproved, to Revenue and Treasury. The packet will contain all
materials relevant to the application.

(c)Renewal of permits will be processed according to the same procedure as the initial
application for a permit.
346.3 ENFORCEMENT
The enforcement of the City Ordinances which regulate the activities of Peddler/Solicitor is
predominantly the responsibility of the Police Department. The police officer should generally
handle all such matters through citation or, if absolutely necessary, arrest for violations of the
following sections (refer to Solicitor's Permit Enforcement Guide; sections listed are City of
Fremont Municipal Codes):
(a)5-4104
1.Must have valid permit to engage in commercial Peddler/Solicitor activities. (This
section does not apply to registered, charitable non-profit groups. Registered,
charitable non-profit groups are issued the attached Form #1161-8/89, and it
should be displayed.)
(b)5-4110
1.The permittee must keep I.D. card in possession. (This section does not apply
to registered, charitable non-profit groups.)
(c)5-4114
1.No person shall act as a Peddler/Solicitor between 9:00 p.m. and 9:00 a.m.
(d)5-4115
1.Soliciting or peddling on posted property prohibited.
