Policy 339Fremont Police Department Alcoholic Beverage Control (ABC) - Enforcement and Inspection Guidelines 339.1 PURPOSE AND SCOPE This policy is designed to establish uniformed guidelines in the enforcement of Alcoholic Beverage Control Laws and the inspection of licensed premises. The enforcement of Alcoholic Beverage Control Laws are the responsibility of the Alcoholic Beverage Control Board. It is, however, incumbent upon the Fremont Police Department to conduct necessary and reasonable inspections of licensed premises for the purpose of enforcing violations that could result in an immediate and direct adverse affect on individuals or the public safety. 339.2 ENFORCEMENT AND INSPECTION PROCEDURES The following procedures shall be followed when conducting inspections of licensed premises: (a)No more than two (2) uniformed officers should enter premises. (b)Should it be determined that hazardous conditions may exist, a supervisor is to be apprised of the situation and approval requested to increase number of officers entering premises. (c)Advise manager or person in charge of your intentions and request his/her cooperation. (d)Verification of person's age should be undertaken only when the officer has reasonable cause to believe the person may be under age. (e)If establishment serves dinner, dining area and non-drinkers should not be checked, unless an obvious violation is observed. (f)If violations involving underage persons drinking are observed, person should be cited and any false ID cards confiscated as evidence. (g)Do not tell managers or persons in charge how to run business. If there are violations, take appropriate action. Forward all reports involving ABC violations to the Special Investigator. (h)Do not shine flashlights in eyes (face) of customers. (i)Checks should be kept low key with only potential violators being checked, as opposed to checking each and every person. (j)Only if there are strong indications of intoxication, or it becomes necessary to interview a person after initial contact, should a person be requested to accompany the officer outside the premises.
