Policy 309Fremont Police Department Firearms 309.1 PURPOSE AND SCOPE This policy provides guidelines for issuing firearms, the safe and legal carrying of firearms, firearms maintenance, and firearms training. This policy does not apply to issues related to the use of firearms that are addressed in the Use of Force or Officer-Involved Shootings/Great Bodily Injury Incidents policies. This policy only applies to those members who are authorized to carry firearms. 309.2 POLICY The Fremont Police Department will equip its members with firearms to address the risks posed to the public and department members by violent and sometimes well-armed persons. The Department will ensure firearms are appropriate and in good working order and that relevant training is provided as resources allow. 309.3 AUTHORIZED FIREARMS, AMMUNITION, AND OTHER WEAPONS Members shall only use firearms issued or approved by the Department and thoroughly inspected by the Range Master or designee. Except in an emergency or as directed by a supervisor, no firearm shall be carried by a member who has not qualified with that firearm at an authorized department range. All other weapons not provided by the Department, including, but not limited to, edged weapons, chemical or electronic weapons, impact weapons or any weapon prohibited or restricted by law or that is not covered elsewhere by department policy, may not be carried by members in the performance of their official duties without the express written authorization of the member's Division Commander. This exclusion does not apply to the carrying of a single folding pocketknife that is not otherwise prohibited by law. 309.3.1 HANDGUNS The following department-issued handguns are approved for on-duty use: MAKE MODEL CALIBER Sig Sauer P320 Full RDO 9mm Sig Sauer P320 Carry RDO 9mm Sig Sauer P320 Compact RDO 9mm Sig Sauer P320 Sub-Compact .40 Cal Sig Sauer P365XL/Macro RDO 9mm Ruger Mark .22 Cal The Fremont Police Department provides Red Dot Optic (RDO) firearms equipped with the Sig Sauer Romeo Pro 1 optic. Published with permission by Fremont Police DepartmentFirearms - 1 Fremont Police Department Firearms 309.3.2 BREACHING SHOTGUNS The following department-issued breaching shotgun is approved for on-duty use: MAKE MODEL Remington Pistol Grip Breaching shotgun 870 (a)Purpose and Scope: 1.The department authorizes the use of the breaching shotgun to quickly force entry through locked and/or barricaded doors. The breaching shotgun allows officers to defeat doors that mechanical breaching tools would normally be unable to open. The primary function of the breaching shotgun is for forcing entry. Although the breaching shotgun is a firearm, it has been modified for breaching purposes. The selected ammunition is also frangible and designed to defeat door locks and hinges. (b)When the Breaching Shotgun May Be Used: 1.Patrol Deployments: (a)When a decision has been made to conduct an emergency entry, the breaching shotgun may only be used when it appears reasonably necessary to prevent death or great bodily injury. Officers are also required to obtain a supervisor's approval unless the circumstances make it impractical to obtain authorization and/or delayed response would jeopardize the safety of citizens, officers, or suspect(s). 2.SWAT Deployments: (a)The breaching shotgun may be used in tactical operations when reasonably necessary to provide a tactical advantage and enhance the safety of citizens, officers or suspect(s). Deployment during tactical operations shall be approved by the SWAT Commander unless the circumstances make it impractical to obtain authorization, and/or delayed response would jeopardize the safety of citizens, officers, or suspect(s). (c)Deployment Considerations: 1.Supervisors and officers should consider various factors in determining the effectiveness of the breaching shotgun for incidents where it is deployed. These factors include but are not limited to: (a)Selection of personnel to deploy the breaching shotgun; for example, using SWAT team members to deploy the breaching shotgun versus using such personnel for entry purposes. (b)The risk of a failed breach and secondary options. (c)The need for manual breaching tools to support the breaching shotgun. (d)Verbal warning to the occupants behind the door. (e)Advisement to other officers that a shotgun breach is about to occur. (f)Preparation of an entry team to follow the shotgun breach if necessary. (d)Weapon of Opportunity: 1.Although the primary function of the breaching shotgun is to force entry, this policy does not restrict the use of the breaching shotgun as a lethal weapon of opportunity if the use of this device complies with the Use of Force policy.
