Policy 217Fremont Police Department Ohlone College Memorandum of Understanding 217.1 PURPOSE AND SCOPE The Fremont Police Department and the Ohlone College Campus Police Services will cooperate to provide efficient and expedient law enforcement services for the Ohlone College Fremont campus. The purpose of this policy is to establish the responsibilities of officers/employees of the Fremont Police Department and the officers/employees of Ohlone College Campus Police Services, including criminal activity, investigations, and arrests; traffic issues; and special problems. 217.2 PATROL ACTIVITY Fremont Police Department officers will routinely patrol the Ohlone College campus and are authorized to take enforcement action. 217.3 CRIMINAL ACTIVITY AND INVESTIGATIONS (a)Liaison 1.Police issues should be the responsibility of the Chief of Police and the President of the College. The Community Policing Patrol Division Commander and an assistant to the President are designated as alternates. 2.Operational incidents are to be initially discussed by Ohlone College Campus Police Services (CPS) and the day shift Watch Commander. (b)Fremont Police Department to be immediately notified and will respond and assist in the investigation of all major crimes. 1.Homicides 2.Rapes or attempted rapes 3.Assaults with a deadly weapon 4.Assaults resulting in serious injury 5.Robberies 6.Sex offenses 7.Crimes with suspects - Crimes with suspects are turned over to the Fremont Police Department for further investigation. 8.Vehicle Thefts - Vehicle thefts require entry into the Stolen Vehicle System and a documenting report to be kept on file; therefore, the Fremont Police Department will take the initial report and conduct all investigative follow-up. 9.Burglaries (a)Ohlone College CPS will handle cold burglaries. (b)Stolen license plates require entry into the Stolen Vehicle System; therefore, the Fremont Police Department will take the initial report and conduct all investigative follow-up. 217.4 TRAFFIC (a)Collisions 1.The Fremont Police Department is to be immediately notified and will be responsible for the investigation and reporting of traffic collisions, if any of the following elements are involved: (a)Visible injury (b)Complaint of pain, if the person is transported to the hospital by ambulance (c)A City of Fremont vehicle 2.CPS personnel will be responsible for determining that drivers involved in other property damage accidents comply with State law. They will investigate and report on the following types of collisions: (a)Collisions resulting in campus property damage (b)Collisions involving possible College liability (c)Non-injury traffic collisions (d)Complaint of pain collisions, not resulting in a transport by ambulance (e)Non-injury hit-and-run traffic collisions (f)Complaint of pain hit-and-run traffic collisions, not resulting in a transport by ambulance (g)Injury collisions when Fremont Police Department Traffic Unit personnel are not available (b)Parking Violations: (a)Campus personnel will be responsible for the enforcement of all parking restrictions. If a warrant is issued, it is assigned to Alameda County Sheriff's Office. (c)Towing vehicles: (a)When Campus Police Officers are on duty, CPS handles the towing of vehicles. (b)When Campus Police Officers are not on duty, towing of vehicles will be handled by the Fremont Police Department, at the request of Ohlone College Campus Security. (c)Vehicles towed by the Fremont Police Department are subject to the vehicle release fees of the department. 217.5 SPECIAL PROBLEMS (a)Narcotics - Information on possible narcotics activity involving transportation and sale will be provided to appropriate personnel of the Fremont Police Department. The Office of the President and/or Campus Police Services should be notified if surveillance on campus is conducted. (b)Disruptions - Faculty personnel will have initial responsibility for handling persons disrupting an educational activity. Security personnel, if summoned, should immediately evaluate the situation. The Fremont Police Department should be notified and assistance requested if there are a large number of persons involved or there exists a present danger of the situation escalating. (c)Demonstrations - Control of planned demonstrations will be the responsibility of the Office of the President and administrative officials. The Fremont Police Department should be notified at the earliest possible time, in case it becomes necessary to request the assistance of the Fremont Police Department. (d)Bomb Threats - Persons on campus receiving information of a bomb threat should notify the Office of the President and Campus Police Services. The Fremont Police Department should be notified and their assistance requested if the incident is seen as a real threat, or the President or his representative requests assistance. 217.6 REPORT NUMBERS (a)The Fremont
