Policy 216Fremont Police Department Exceptional Police Services 216.1 PURPOSE AND SCOPE The Police Department will provide immediate response and assistance for any emergency or urgent situation, which serves the best interests of the community and general public. Once an emergency or urgent situation ceases to exist or is stabilized, and the further use of police employees serves basically a special interest group or situation, the cost of such police services shall be borne by the responsible company or person(s). The purpose of this policy is to establish guidelines for police services not provided the general public, which serve a special interest for a specific purpose, as required or requested. 216.2 PROCEDURE Whenever a situation exists that appears to require police assistance for an extended period of time, the Watch Commander will immediately be notified. It will then be the responsibility of the Watch Commander to determine the status - if it is an emergency or urgent situation or if a special interest is being served. (a)The Watch Commander, or designee, should discuss the matter with one or more responsible person(s) representing the special interest group (organization, company, utility, agency, etc.). If possible, the two parties should attempt to reach mutual agreement as to the the type of assistance required, the responsibility of the police, and the responsibility of the special interest group. (b)Once the decision is made that the police are providing "exceptional services," the responsible person(s) should be informed that the cost of such services are their responsibility, and the special interest group will be charged in accordance with the current City of Fremont billing rate schedule. (c)When exceptional police services are provided, the Watch Commander will submit a memorandum to the Community Policing Patrol Division Commander, outlining the circumstances of the incident, the total hours of service provided, and the amount of expendable items used (e.g., flares, etc.). (d)Whenever, in the opinion of the Watch Commander, there exists a need for traffic control or other police services, and the questions of responsibility cannot be resolved, the service will be provided and the matter referred to the Community Policing Patrol Division Commander for review and recommendation.
