Training Review Boards
213.1 PURPOSE AND SCOPE
It shall be the policy of the Fremont Police Department to review past incidents for the purpose
of determining whether training would likely improve future outcomes. This policy establishes
procedures for review of certain traffic collisions, firearm discharges, pursuits, uses of force, or
any incident deemed appropriate for such review by the Chief of Police.
The purpose of the review is to lead to the improvement of our training programs; it is not for the
purpose of administrative review leading to punitive action against the employee. If suspected
violations of law, rules, policies, or procedures are discovered, the Training Review Board shall
immediately cease its inquiry and refer the matter to the Office of Professional Standards and
Accountability after advising the Chief of Police and the appropriate division commander. No
statements used in the Review Board process shall be used for an internal affairs investigation
or serve as the basis for punitive action. Any and all findings that result from the Review Board
process will be maintained by the Police Department Training Unit, and shall not be filed or indexed
by employee name or identification number.
213.1.1 DEFINITIONS
(a)Traffic collisions subject to review for training purposes are defined as any collision
involving:
1.Any person operating a City-owned or other vehicle held by the City; or
2.On-duty personnel driving any vehicle, whether City-owned, rented, or seized.
(b)Shooting incidents subject to review for training purposes are defined as any shooting
incident involving:
1.A Department employee, on- or off-duty, intentionally discharging a firearm; or
2.An accidental or intentional firearm discharge, at an approved range or other
appropriate facility/location, resulting in injury.
(c)Issues of other use of force subject to review for training purposes are defined as any
use of force involving:
1.Departmental employee(s), on- or off-duty, using force in a manner or to a
degree that, in the opinion of the Chief of Police, requires review.
(d)Incidents involving a vehicle pursuit subject to review for training purposes are defined
as any pursuit involving:
1.A department employee driving a marked or unmarked City vehicle.

213.2.1 INITIATION
(a)A Training Review Board may be formed upon the occurrence of a traffic accident,
shooting incident, or other use of force. Training Review Boards for other incidents
may be formed at the discretion of the Chief of Police.
(b)Any employee may recommend to the Division Commander a review be conducted.
Authority to initiate the review rests with the Division Commander.
(c)It shall be at the discretion of the Division Commander to initiate a review process
when an incident is still under active investigation. Before making this decision, the
Division Commander shall consult with the investigating party regarding any intent to
initiate a review of the incident currently under active investigation.
(d)The decision to convene a Training Review Board should be established no longer
than 45 days from the date of the event; however, the decision to convene a Training
Review Board may be reconsidered or revoked, should circumstances (e.g., grand
jury or other specific litigation interests) dictate.
(e)The scheduling of the Training Review Board should be conducted as soon as
practical, taking into consideration such factors as the availability of an appropriate
chairperson, the availability of involved employees, the number and sequence of
events to be scheduled, and other department priorities.
213.2.2 NOTIFICATION OF INTENT TO CONVENE
(a)Incidents subject to review for training purposes shall be reported to the Division
Commander via the Chain of Command as soon as possible, but in no case more
than thirty (30) days after the incident. Any incident, which includes a traffic collision,
discharge of a firearm, pursuit, or use of force, shall be documented in an official police
report.
(b)In the event the involved employee is unable to notify the Division Commander, the
employee's supervisor shall make such notification as soon as possible considering
the circumstances of the incident.
(c)The Chief of Police retains the right to refer a situation that comes to his/her attention
to a Training Review Board, with notification to the appropriate Division Commander.
213.2.3 DOCUMENTATION OF THE INCIDENT
(a)Appropriate documentation of the incident shall be prepared under the direction of the
Division Commander by their designee
(b)Documentation may be in the following form as appropriate:
1.Arrest Report
2.Crime Report

213.2.4 NOTIFICATION TO PARTICIPANTS
All notifications of a review board process will use one of two formats (see Appendix 215).
Attachment 1 refers to personnel who have been selected to be interviewed. Attachment 2 refers
to personnel who have been selected as Subject Matter Experts.
213.2.5 ALTERNATIVES
(a)Upon learning of any of these incidents, the employee's division commander, in
conjunction with the Training Unit, may choose to handle the matter directly. If the
Division Commander chooses to handle the matter, the Division Commander, or
designee, shall prepare a report as described in this policy.
