Policy 1043Fremont Police Department Occupational Disease and Work-Related Injury Reporting 1043.1 PURPOSE AND SCOPE The purpose of this policy is to provide guidance for the reporting of on-duty injuries, occupational illnesses, or deaths to Risk Management, to ensure proper medical attention is received, and document the circumstances of the incident. 1043.1.1 DEFINITIONS Definitions related to this policy include: Occupational disease or work-related injury - An injury, disease or psychiatric injury arising out of employment (Labor Code § 3208; Labor Code § 3208.3; Labor Code § 3212 et seq.). Accident - Any occurrence from which bodily injury or property damage may result, regardless of whether any injury or damage actually does occur (e.g., exposure where no immediate injury is apparent). 1043.2 POLICY The Fremont Police Department will address occupational diseases and work-related injuries appropriately, and will comply with applicable state workers’ compensation requirements (Labor Code § 3200 et seq.). All illness or injuries to members of this department occurring during the scope of employment shall be reported, documented, and medically treated, if necessary, as outlined by law, City Administrative Regulations, and this policy. The physician of record will determine and prescribe short and long-term medical treatment of work-connected illness or injury. In the event of a work-related illness or injury, an employee has two options to determine the physician of record. (a)(a) The City of Fremont designated physician is currently Fremont Urgent Care and Kaiser Permanente Department of Occupational Medicine. Fremont Urgent Care and Kaiser Permanente Department of Occupational Medicine shall be utilized for initial and possibly long-term treatment of the illness or injury. Critical or life-threatening illness or injury requiring emergency treatment, or non-critical after-hours illness or injury requiring immediate treatment shall first be treated by an appropriate certified emergency facility (Washington Hospital, Kaiser Permanente, Eden Hospital, etc.), with follow-up treatment coordinated by Fremont Urgent Care and Kaiser Permanente Department of Occupational Medicine. Fremont Urgent Care and Kaiser Permanente Department of Occupational Medicine are capable of providing most emergencyand non-emergency medical treatment. Employees requiring treatment for non-life- threatening conditions during hours of operation of Fremont Urgent Care should consult them first. (b)In lieu of being treated by the City of Fremont's designated physician, an employee may pre-select a personal physician of his/ her choice. Published with permission by Fremont Police DepartmentOccupational Disease and Work-Related Injury Reporting - 1 Fremont Police Department Occupational Disease and Work-Related Injury Reporting emergency treatment, the pre-selected personal physician shall prescribe primary initial and long-term medical treatment. 1.The personal physician must qualify under Title 8, California Code of Regulations, Predesignation Regulations 9780 and 9783. The employee will be responsible for the cost of medical care received from the personal physician if, at the time of treatment, the personal physician is not qualified under the Labor Code, or the illness/injury is deemed to be not job-related. 2.An employee who preselects a personal physician must have a City of Fremont Personal Physician Pre-Selection form on file with the City of Fremont Risk Management Department and his/her Police Department administrative file prior to treatment. The Police Administration will support an employee's efforts to seek authorized treatment for all job-related illnesses and injuries. All employees who encounter difficulty in receiving authorized treatment are encouraged to contact their Division Commander. The Division Commander will then review the situation with Risk Management. Employees are also free to contact Risk Management directly, if they so desire. 1043.3 RESPONSIBILITIES 1043.3.1 MEMBER RESPONSIBILITIES Any member sustaining any occupational disease or work-related injury shall report such event as soon as practicable, but within 24 hours, to a supervisor, and shall seek medical care when appropriate (8 CCR 14300.35). Any employee observing or learning of a potentially hazardous condition is to promptly report the condition to his/her immediate supervisor. Any employee sustaining a work-related injury or illness that requires relief from duty is required to be examined/treated by a doctor. Any employee sustaining a work-related injury or illness that requires relief from duty is also required to comply with departmental policies relating to the duty to periodically call in during absences, as well as the duty to notify the Department of any change in condition or anticipated duration of the absence. When appropriate, an employee being treated for an on-duty injury should inform the attending physician that a modified duty assignment may be available at the Department. Limited-service duty may be available for the employees whose injuries prevent resumption of regular duties. With the exception of pregnancy, a modified duty assignment should be short-term with period review of the status for reassignment to full duty. Extensions of the modified duty assignment may be granted by the Chief of Police in conjunction with the Risk Manager, however, the department does not provide any permanent modified duty assignments.
