Policy 1027Fremont Police Department Mandatory Overtime 1027.1 PURPOSE AND SCOPE The purpose of this policy is to establish the operational guidelines and individual responsibilities for the implementation and compliance of mandatory overtime within the Patrol Division. The Chief of Police shall implement mandatory overtime to fill vacancies within the Patrol Division when it is deemed necessary. The policy does not apply to emergency situations, special events that require additional police services, officers held over on their shift, or officers coming in early for their shift. 1027.2 GUIDELINES Mandatory overtime will apply to vacancies on individual Patrol shifts that require backfill to meet service minimum levels. A two-tier implementation procedure will be used based on the overtime needs of the Patrol Division. (a)Employees subject to Tier One implementation of the Patrol Division mandatory overtime include the following: 1.Police Sergeants and Officers assigned to the Patrol Division. 2.Police Sergeants and Officers assigned to the Traffic Unit. 3.Police Officers assigned to specialty assignments within the Patrol Division, such as, K-9 Officers and Crime Scene Investigators (CSI). 4.Police Sergeants and Officers assigned to the Street Crimes Unit and MET. (b)Employees subject to Tier Two implementation of the Patrol Division mandatory overtime include the following: 1.Police Sergeants and Officers assigned to the Investigations Unit. 2.Police Sergeants and Officers assigned to the Special Investigations Unit. (c)Employees subject to Tier Three implementation of the Patrol Division mandatory overtime include the following: 1.Police Sergeants and Officers assigned to the School Resource Officer Program. 2.Police Sergeants and Officers assigned to the Training and Personnel Units. 3.Police Sergeants and Officers assigned to SACMCTF, REACT, and RCFL. (d)Employees excluded from Patrol Division mandatory overtime include the following: 1.Police Sergeants and Officers on total disability or modified duty status. 2.Police Sergeants and Officers on pre-approved primary and secondary vacations or training assignments. 3.Police Officers assigned as a Trainee in the Field Training Program (FTO). 4.Police Sergeants and Officers assigned to JTTF and Internal Affairs. 5.Investigators assigned as the "On-Call Detective." Published with permission by Fremont Police DepartmentMandatory Overtime - 1 Fremont Police Department Mandatory Overtime 6.Police Sergeants and Officers who have received prior authorization from a Division Commander. 1027.3 OPERATIONAL GUIDELINES Mandatory Patrol Division overtime will be implemented pursuant to the following factors: (a)Department Seniority 1.Police Sergeant seniority will be determined by time in rank. 2.Police Officer seniority will be determined by time as a sworn officer with the City of Fremont. Specialty Assignment Unit seniority will not be a factor pursuant to this policy. 3.The mandatory overtime lists will begin with the least senior employee. (b)Position on the Mandatory Overtime List 1.Rotating mandatory overtime lists will be created for each Patrol side (A and B teams) and schedule (day shift, swing/mid-shift). The lists will be circular so that each employee eligible to work mandatory overtime will move down to the bottom of the list after being selected to work a mandatory overtime shift. 2.Rotating mandatory overtime lists will also be created for Tier One and Tier Two implementations. 3.Mandatory overtime lists will be posted on the shared drive ("T" drive) for informational and accuracy verification by all employees. 4.No consideration will be given for Patrol Division overtime worked on a voluntary basis. This guideline shall be considered different from the hold-over policy. (c)Employees mandated to work Patrol Division overtime are subject to the following rules: 1.Employees will be provided at least 16 days notice of mandated overtime. The notice does not apply to officers being mandated to hold over at the conclusion of their regularly scheduled Patrol shift or under emergency circumstances. 2.Employees may only be ordered in for one Patrol shift per scheduled cycle of days off. 3.Employees subject to Tier Two and Tier Three implementation may only be ordered in for one Patrol shift per scheduled day off cycle and will be mandated to work between the hours of 0600 and 0100 hours. 4.Employees assigned to Day Shift Patrol Teams will only be mandated to work between the hours of 0600 and 2200 hours on the opposing side. 5.Employees assigned to Swing Shift and Midnight Shift Patrol Teams will only be mandated to work between the hours of 1400 and 0700 on the opposing side. 6.Employees with a collateral specialty assignment will be assigned to work within a zone but may assume their normal specialty assignment duties per the discretion of the Watch Commander.
