STANDARDS: 22 PAGES: 2 CONTENTS This general order contains the following sections: PURPOSE The purpose of this general order is to establish guidelines for collective bargaining in accordance with Chapter 447 of the Florida State Statutes. SCOPE These procedures shall apply to all Fort Myers Police Department personnel. POLICY (C.A.L.E.A. 22.3.1) In accordance with the guidelines of the Florida Public Employee Relations Commission (P.E.R.C.) and F.S.S. 447, the City of Fort Myers recognizes the International Union of Police Associations (I.U.P.A. Local 6065) as the Sworn Employees and Dispatchers and Dispatcher Supervisors exclusive bargaining agent to represent them in all contract negotiations. The city also recognizes the International Union of Painters and Allied Trades (I.U.P.A.T.), Local Union 2301 as the exclusive bargaining agent for the non-sworn civilian employees. (C.A.L.E.A. 22.3.1b) A. The city's chief negotiator and team shall be composed of the city's Director of Human Resources and other personnel selected by the City Manager. (C.A.L.E.A. 22.3.1a) B. The role of the police department’s Command Staff in the negotiations shall be one of an advisory nature. C. Sworn bargaining unit members shall select their bargaining team pursuant to current I.U.P.A. guidelines. D. Non-sworn bargaining unit members shall select their bargaining team pursuant to current Fort Myers City Employees Union (I.U.P.A.T. Local Union 2301) guidelines. E. The I.U.P.A. represents Lieutenants, Sergeants, Officers, Dispatchers and Dispatch Supervisors while the I.U.P.A.T. Local Union 2301 represents other non-sworn civilian employees. PROCEDURES A. PROCEDURES PRIOR TO NEGOTIATION: The chief negotiators of both teams will decide at the outset of negotiations the following: (C.A.L.E.A. 22.3.1d) 1. Any compensation that members of the bargaining team are entitled to. 3. Time schedules, agenda, proposals, and deadlines for the negotiations. 4. Procedures for governing the release of information to third parties during the entire bargaining process. 5. Method of recording any deliberations. 6. Method for introducing issues. 7. Resolution of impasses shall be affected as per F.S.S. 447.403 and any amendments thereto. 8. The department shall abide by the established ground rules during the negotiations and shall abide, in both letter and spirit, to the negotiated agreement as signed by management, labor representatives, and ratified by the bargaining unit. (C.A.L.E.A. 22.3.1e) B. PROCEDURE DURING CONTRACT NEGOTIATIONS: 1. Department management staff should refrain from discussion with bargaining unit members any items/issues under review. 2. The chief negotiators and the department representative shall participate in negotiations, based on good faith bargaining as outlined in F.S.S. 447.203. (C.A.L.E.A. 22.3.1c) C. POST NEGOTIATION PROCEDURES: (C.A.L.E.A. 24.3.2) 1. Upon the completion of the bargaining process, the Chief or designee shall: a. Obtain a written, signed copy of the labor agreement.(C.A.L.E.A. 22.3.2a) b. Review and amend, if necessary, all written directives and procedures to coincide with the terms of the agreement. (C.A.L.E.A. 22.3.2b) c. Disseminate information relative to the new labor agreement, including modifications to existing agreements, to all managers and supervisors of bargaining unit members.
