3.115 IMMUNITY FROM ARREST Certain specified persons are immune from arrest under certain conditions; however, officers shall report details of the incident on an offense report form. Diplomatic officer; i.e. Ambassadors and Foreign Ministers on official visits, and certain members of their families and staff; are immune from arrest for any offense. Career consular officers, i.e. Consuls-General, Deputy Consuls- General, Consuls, and Vice Consuls, are immune from criminal prosecution for acts performed in the exercise of consular functions (subject to court determination) except in the cases of a felony offense that would endanger the public safety. United States legislators are generally immune from arrest while the legislature is in session and while traveling to and from a session.
