DAYS OF THE OCCURRENCE, OR OF KNOWLEDGE OF THE OCCURRENCE
OF THE EVENTS WHICH GAVE RISE TO THE GRIEVANCE. SUCH
GRIEVANCE SHALL BE PRESENTED AND ADDRSSED TO THE SUPERVISOR
IN WRITING, SHALL BE SIGNED BY THE EMPLOYEE, AND SHALL SPECIFY
THE FOLLOWING:
• THE DATE AND TIME OF THE ALLEGED GRIEVANCE
• THE SPECIFIC ARTICLE(S) OF THE COLLECTIVE BARGAINING
AGREEMENT OR DEPARTMENT DIRECTIVE ALLEGEDLY VIOLATED
• THE FACTS PERTAINING TO OR GIVING RISE TO THE ALLEGED
GRIEVANCE
• THE REMEDY REQUESTED
THE EMPLOYEE’S IMMEDIATE SUPERVISOR SHALL INDICATE ON THE
FORM THE TIME AND DATE WHICH IT WAS RECEIVED, AND FORWARD A
COPY OF SAME TO THE MAYOR’S OFFICE.

THE EMPLOYEE’S IMMEDIATE SUPERVISOR SHALL, WITHIN TEN (10)
CALENDAR DAYS AFTER THE PRESENTATION OF THE GRIEVANCE (OR
SUCH LONGER PERIOD OF TIME AS IS MUTUALLY AGREED UPON),
RENDER HIS/HER DECISION ON THE GRIEVANCE IN WRITING.
STEP TWO: IN THE EVENT THAT THE EMPLOYEE IS NOT SATISFIED WITH
THE DISPOSITION OF THE GRIEVANCE IN STEP ONE, HE/SHE SHALL HAVE
THE RIGHT TO APPEAL THE IMMEDIATE SUPERVISOR’S DECISION TO THE
POLICE CHIEF WITHIN TEN (10) CALENDAR DAYS AFTER THE DATE OF
THE ISSUANCE OF THE SUPERVISOR’S DECISION. SUCH AN APPEAL MUST
BE ACCOMPANIED BY THE FILING OF A COPY OF THE ORIGINAL WRITTEN
GRIEVANCE TOGETHER WITH A LETTER SIGNED BY THE EMPLOYEE
REQUESTING THAT THE SUPERVISOR’S DECISION BE REVERSED OR
MODIFIED. THE POLICE CHIEF SHALL, WITHIN TEN (10) CALENDAR DAYS
(OR SUCH LONGER PERIOD OF TIME AS IS MUTUALLY AGREED UPON),
RENDER HIS/HER DECISION IN WRITING. THE POLICE CHIEF SHALL
SCHEDULE A MEETING WITH THE GRIEVANT PRIOR TO RENDERING
HIS/HER DECISION IF SO REQUESTED BY THE GRIEVANT.
THE CHIEF SHALL INDICATE ON THE FORM THE TIME AND DATE WHICH
IT WAS RECEIVED, AND FORWARD A COPY OF SAME TO THE MAYOR’S
OFFICE.

STEP THREE: IN THE EVENT THAT THE EMPLOYEE IS NOT SATISFIED WITH

THE MAYOR SHALL, WITHIN TEN (10) CALENDAR DAYS (OR SUCH
LONGER PERIOD OF TIME AS IS MUTUALLY AGREED UPON), RENDER
HIS/HER DECISION IN WRITING. THE MAYOR SHALL SCHEDULE A
MEETING WITH THE GRIEVANT PRIOR TO RENDERING HIS/HER DECISION
IF SO REQUESTED BY THE GRIEVANT.
CIVILIAN EMPLOYEES ARE LIMITED TO GRIEVANCES THOUGH THEIR
RULING BY THE MAYOR, WHOSE DECISION SHALL BE CONSIDERED
FINAL. THE SAME IS TRUE OF BARGAINING UNIT MEMBERS WHOSE
GRIEVANCE DOES NOT INVOLVE PROVISIONS OF THE COLLECTIVE
BARGAINING AGREEMENT.
BARGAINING UNIT MEMBERS WHOSE GRIEVANCES REMAIN
UNRESOLVED BY THE ABOVE LISTED STEPS SHOULD CONSULT THE
POLICE BENEVOLENT ASSOCIATION FOR FURTHER REMEDIES WHICH
ARE ALSO LISTED IN THE COLLECTIVE BARGAINING AGREEMENT.

THE POLICE BENEVOLENT ASSOCIATION WILL BE FURNISHED WITH A
COPY OF EACH GRIEVANCE FILED BY AN EMPLOYEE WITHIN THE
BARGAINING UNIT, AND THE CITY’S RESPONSE THERETO. COPIES OF
ALL DOCUMENTATION SHALL BE RETAINED IN THE EMPLOYEE’S
PERSONNEL FILE IN ACCORDANCE WITH THE STATE’S RECORDS
RETENTION GUIDELINES. [CFA 10.05]
