1 EDGEWOOD POLICE DEPARTMENT REGULATION REGULATION 800, INVESTIGATIONS, ARRESTS, AND DETENTIONS EFFECTIVE: 3/30/2023 DISTRIBUTION: ALL EMPLOYEES REVIEW RESPONSIBILITY: CHIEF OF POL ICE ACCREDITATION CHAPTERS : 2, 4, 21 CHIEF OF PO LICE: DEAN DESCHRYVER 800-1, INVESTIGATIONS Investigations at the scene of any crime, accident, or other police incident shall be conducted in accordance with current Departmental directives. 800-2, ARRESTS It is the policy of the Edgewood Police Depart ment to apprehend viol ators of the law in accordance with the following guidelines: a. Improper A person shall not be arrested or detained except as provided by law. Members shall make a complete and thorough search for weapons and contraband of the persons arrested/detained and of the area within their immediate reach. Any member receiving a prisoner/detainee for transport from another officer, or from a representative of another agency, shall also conduct such a search of the prisoner/ detainee before transp orting. b. Use of Force Members shall use only the degree of force necessary to affect lawful objectives . c. Treatment of Prisoners/Detainees All prisoners/detainees shall be treated humanely and with regard to their legal rights. d. Duty to Report Violations It shall be the duty of each employee to report to his/her immediate supervisor any violations of this Regulation by any employee . 800-3, REPORTING CRIMINAL INFORMATION Employees shall report to their immediate super visor any criminal infor mation prior to the end of the curr ent tour of duty: a. All information of criminal activity or suspected criminal activity that comes to their attention. b. All reports to appropriate agencies of criminal activity or suspected criminal activity that occurs o utside this Department's jurisdicti on. c. Self-assigned investigations of any nature. d. Employees shall make an immediate verbal report to their superior . If the violation involves a superior, the Chief of Pol ice shall be notified directly, in writin g via email o r intra -departmental mail , prio r to the end of the current tour of duty. e. All information , when an employee becomes aware , of any Edgewood Police Department employee (on or off duty) who has violated any federal, state, or local ordinance. f. All information co ncerning any arrest or court a ction against the employee for criminal action. g. Off-duty employees shall make their written report no later than their next tour of duty; an immediate verbal report shall be made of serious incidents. REGULATION 800 Page 2 2 800-4, TRA NSPORTING PRI SONERS/DETAINEES Arresting members shall, without unnecessary delay, convey their prisoners/detainees to the detention facilities and shall not permit their prisoners/detainees any special privileges , nor shall members accomp any prisoners/detainees to their homes or rooms without prop er authorization from the immediate superior on duty. This shall not be construed to exclude the use of reasonable kindness in the interest of humane treatment. Members shall provide priso ners/detainees in the rear of police v ehicles with an adequate sourc e of ventilation compatible with existing weather conditions. At all times , a marked patrol unit will be used to transport prisoners/detainees to the Orange Cou nty Booking Office. The seatbelts in m arked patrol units will be applied to the prisoner/detai nee. All prisoners/detainees should be placed in the back seat of a marked patrol . If a prisoner is intoxicated or inc apacitated, they should be transported by a marked patrol unit or amb ulance. Under no circumstances should any prisoner/detainee be placed in the front seat of any department vehicle. One transport member (driver) may be used to transport any non -violent prisoner/detainee or mult iple non -violent prisoners/detainees. Two mem bers should be used to transport any violent prisoner/detainee, when possible. The front passenger member should monitor the prisoner/detainee for any signs of additional violent behavior. For officer safety purposes, an additional member should follow the unit transporting any violent prisoner/detainee. Should a violent prisoner/detainee need to be transported to a hospital by ambulance, a member should ride in the back of the ambulance with the prisoner/detain ee and emergency personnel, while followed by another member in a marked vehicle. It is the responsibility of th e arresting member to ensure that a member remains with all prisoners/detainees from the point of arrest until custody is released to th e proper correctional officer, unless extreme circum stances exist where this Regulation becomes impractical. Activities of persons taken into custody shall be monitored at all times . Every effort will be made to ensure prisoners/detainees do not injure the mselves or cause property damage. In the event a tr ansporting member observes any activity that requires police action, the member shall notify Communications immediately for assignment of another unit. If the transporting member deems that an emergency exists and delay of action would create unreasonable ri sk or injury to the general public, the member should attempt to obtain supervisory approval prior to taking
