Policy Delano Police Department 412 Delano PD Policy Manual Line Ups 412.1 PURPOSE AND SCOPE The Delano Police Department Police Department recognizes that eyewitness evidence frequently plays a vital role in uncovering the truth about crimes. The evidence provided by eyewitnesses can play a critical role in identifying, charging and ultimately convicting suspected criminals. That is why it is absolutely essential that eyewitness evidence be accurate and reliable. One way of ensuring we, as investigators, obtain the most accurate and reliable evidence from eyewitnesses is to follow sound protocols in our investigations. 412.1.1 OBJECTIVE To establish procedures for the use of eyewitness identifications involving live lineups, photographic lineups, and in field show(s). 412.1.2 DEFINITIONS Eyewitness ‚" A person whose identification by sight of another person may be relevant in a criminal proceeding. Filler ‚" A person or a photograph of a person who is not suspected of an offense and is included in a lineup. Live Lineup ‚" An identification procedure in which a group of similar persons is displayed to an eyewitness for the purpose of determining if the eyewitness is able to identify the perpetrator of a crime. Independent Administrator ‚" A lineup administrator who is not participating in the investigation of the criminal offense and is unaware of which person in the lineup is the suspect. (Person who shows the eyewitness) Photo Lineup ‚" An identification procedure in which an array of photographs is displayed to an eyewitness for the purpose of determining if the eyewitness is able to identify the perpetrator of a crime. Show Up ‚" The presentation of one suspect to an eyewitness in a short time frame and usually in close proximity following commission of a crime. 412.1.3 LIVE LINE-UPS The investigating officer or his/her designee will construct a photographic lineup. When practical, the investigating officer should attempt to have an independent administrator conduct the photo lineup with the eyewitness. The photo lineup(s) presented to eyewitnesses will occur sequentially and separately, in a previously determined order and removed after being viewed before the next photo lineup is shown.
