CONCORD POLICE DEPARTMENT STANDARD OPERATING PROCEDURE CRIMINAL INTELLIGENCE GENERAL ORDER: 08.03 CREATED: April 23, 2021 ISSUE DATE: December 29, 2022 CALEA STANDARD: 40.2.3 EFFECTIVE DATE: December 29, 2022 ACTION: Annual review of general order. REVIEW DATE: January 22, 2024 08.03.0 PURPOSE The purpose of this general order is to establish guidelines for the gathering, analysis, and dissemination of criminal intelligence information. This general order is intended primarily to address organized criminal conduct as it relates to subversive activities, terrorism, homeland security threats, criminal street gang activities, and civil disorders. 08.03.1 POLICY It shall be the policy of the Concord Police Department to gather, analyze and disseminate crimin al intelligence information pertaining to the identity and activities of known criminals, members of terrorist groups, and other individuals or groups suspected of criminal activity posing a threat to law and order in the City of Concord, in accordance with state and federal law. 08.03.2 DEFINITIONS A. CIVIL DISORDER Overt acts of defiance by groups or associations against established laws and rules of order. These acts can result in spontaneous outbreaks of violence resulting in personal injuries and/or destructio n/loss of property. B. CRIMINAL INTELLIGENCE Information that pertains to the organization and operation of criminal activity and its immediate or anticipated impact upon the community from a police perspective. C. SUBVERSIVE ACTIVITY Any overt or covert activity by one or more individuals to achieve goals contrary to law and detrimental to the welfare of the community. Such activities often embrace or adopt resolutions to overthrow established political governments or serve to intimida te and harass ethnic, racial, or religious groups through the use of terrorist acts, civil disorder, or other illegal methods. D. TERRORISM Acts of violence committed against individuals and/or the general public designed to intimidate, harass, and otherwis e cripple or eliminate opposition or resistance to political, mercenary, or commercial goals. General Order 08.03 CRIMINAL INTELLIGENCE Page 2 of 4 08.03.3 INTELLIGENCE GATHERING A. Intelligence activities performed within the department shall include collecting, analyzing, disseminating, and using information related to homeland security activities, terrorism, and criminal activities that present a threat to the community. B. Intelligence gathering activity shall be co nducted and intelligence files shall be established and maintained under the following conditions: 1. Information may be gathered pertaining to known or suspected criminals and criminal operations in order to identify crime patterns and trends, criminal conspiracies, and criminal associates, or to develop probable cause relative to criminal acts or threats of criminal acts; 2. Information may be gathered on violations of law, events, or conditions occurring in other jurisdictions that may be related to criminal activity posing a potential threat to persons or property within the City of Concord; 3. Information may be gathered from both criminal justice and non-criminal justice related sources. All information regardless of the source shall be scrutinized for accur acy and verification sought; 4. The Special Operations Division commander shall work closely with the Crime and Strategic Analysis Unit to analyze all information received by the department to determine its value and relationship to criminal activity. Additional scrutiny shall be given to information received from non -criminal justice sources. C. The collection of intelligence information with no operational value or law enforcement purpose shall be prohibited. D. No intelligence information shall be gather ed or retained solely: 1. For personal interest purposes; 2. For an individual’s religious affiliations; 3. For an individual’s political affiliations; 4. For an individual’s ethnicity or race; 5. Because an individual supports unpopular causes. 08.03.4 STORAGE AND SECURITY OF INTELLIGENCE RECORDS Records pertaining to criminal intelligence are considered confidential and shall be maintained and controlled by the Special Operations Division commander in a secure file separate from the central records system. Electronic criminal intelligence files shall be secured via RMS MODULE: INTELLIGENCE/NARCOTICS. General Order 08.03 CRIMINAL INTELLIGENCE Page 3 of 4 08.03.5 DISTRIBUTION OF INTELLIGENCE RECORDS A. Information developed through intelligence gathering shall be provided by the Special Operations Division or the Crime and Strategic Analysis Unit to officers when necessary to increase the effectiveness of enforcement and deterrence efforts. Officers provided with such information shall report to the appropriate investigator or supervisor the information’s value, timeliness, and any action taken or recommended. Such report shall be maintained in an intelligence file. B. Dissemination of information to other department coworkers or to other law enforcement agencies shall be on a need -to-know basis. C. The department shall maintain liaison with federal, state and local agencies for the purpose of exchanging intelligence information. The Special Operations Division commande r shall be responsible for coordinating efforts between officers and other agencies. D. The department receives bulletins from the North Carolina Information Sharing and Analysis Center (NCISAAC). E. Intelligence information and bulletins received from other law enforcement agencies or entities shall not
