CATEGORY DATE ADOPTED LAS T REVIEW NEXT REVIEW 4 05/29/2014 02/28 /2024 02/28/2028 BUENA PARK POLICE DEPARTMENT GENERAL ORDERS ___________ _________________________________ GO 209 - Law Enforcement Services Agreement Policy 1 POLICY 209 LAW ENFORCEMENT SERVICES AGREEMENT POLICY 209.1 PURPOSE AND SCOPE This policy provide s clear directives for the preparation of written agreements governing law enforcement services provided by the Buena Park Police Department to outside agencies or entities. Written agreements shall be required any time the Department undertakes a contractu al obligation to provide City resources for law enforcement purposes to any other agency or entity. 209.1.1 ACCREDITATION STANDARDS This policy pertains to the following CALEA standards: 3.1.1, 3.1. 2 209.2 EMPLOYMENT RIGHTS OF ASSIGNED PERSONNEL Any contract for law enforcement services shall be drafted and implemented to protect the employment rights of assigne d personnel. Participation in contract law enforcement assignments shall not penalize participating employees or jeopardize promotional opportunities, training opportunities, or fringe benefits. 209.3 PRINCIPLES OF CONTRACT CONSTRUCTION FOR LAW ENFORCEMENT SERVICES CONTRACTS All contracts for law enforcement services shall be written agreements that includ e, at a minimum, the following terms, conditions, and information: a) A statement of the s pecific services to be provided b) Specific language dealing with financial agreements between the parties c) Clear statement of the records to be maintained by each party concerning the performance of services by the provider agency d) Language dealing with the duration, modification, and termination of the contract e) Specific language dealing with risk management and legal contingencies, including insurance and indemnification of parties f) Stipulation that the provider agency maint ains control over its personnel g) Specific a rrangement for the use of equipment and facilities h) A procedure for review and revisi on, if needed, of the agreement 209.4 RECOMMENDATION AND APPROVAL The Chief of Police and the City Attorney shall review all contracts for law enforcement services and authorize a recommendation to the Ci ty Manager. Once the City Manager approve s the contract for City Council consideration, the item will be placed on the next available City Council agenda. No contract for law enforcement services shall be valid until approved by resolution of the Buena Park City Council.
