Explicación Simple

Cuando un testigo no se presenta al tribunal, el juez puede pedirle que firme un documento que garantice su asistencia. Si es menor de edad, alguien más puede firmar por él para asegurar que vaya.

Es como cuando un niño promete hacer su tarea, pero su padre le dice que debe dejar su juguete favorito como garantía de que realmente lo hará.

Ejemplo Práctico

Imagina que Ana es testigo en un caso de robo. El juez, al escuchar que Ana podría no ir al juicio, le pide a su padre que firme un documento para asegurarse de que ella se presente. Si Ana fuera menor de edad, su padre podría hacerlo sin problema.

RCW 10.16.145 - Witnesses -- Recognizances with sureties If the magistrate shall be satisfied that there is good cause to believe that any such witness will not perform the condition of his recognizance unless other security be given, such magistrate may order the witness to enter into recognizance with such sureties as may be deemed necessary for his appearance at court. Formerly codified in RCW 10.16.140, part.] RCW 10.16.150 - Recognizances for minors When any minor is a material witness, any other person may be allowed to recognize for the appearance of such witness, or the magistrate may, in his discretion, take the recognizance of such minor in a sum not exceeding fifty dollars which shall be valid and binding in law, notwithstanding the disability of minority.
