Explicación Simple

Si alguien tiene problemas con el alcohol, drogas o salud mental, un juez puede posponer su audiencia para que busque ayuda. Esto se hace para que la persona reciba un diagnóstico y tratamiento antes de continuar con su caso judicial.

Es como si un estudiante no pudiera pasar de grado porque tiene dificultades en matemáticas. En lugar de hacer un examen final, el maestro le da tiempo extra para asistir a clases de apoyo y mejorar antes de decidir su futuro académico.

Ejemplo Práctico

Imagina que Juan ha sido arrestado por conducir ebrio. Durante su audiencia, su abogado presenta una solicitud diciendo que Juan tiene problemas de alcoholismo. El juez decide posponer la audiencia de Juan y lo envía a un programa de tratamiento para que pueda recibir la ayuda que necesita antes de continuar con su caso.

RCW 10.05.030 - Arraignment continued -- Treatment referral The arraigning judge upon consideration of the petition and with the concurrence of the prosecuting attorney may continue the arraignment and refer such person for a diagnostic investigation and evaluation to an approved alcoholism treatment program as designated in chapter 70.96A RCW, if the petition alleges an alcohol problem, an approved drug treatment center as designated in chapter 71.24 RCW, if the petition alleges a drug problem, to an approved mental health center, if the petition alleges a mental problem, or the department of social and health services if the petition is brought under RCW 10.05.020(2). RCW 10.05.040 - Investigation and examination The *facility to which such person is referred, or the department of social and health services if the petition is brought under RCW 10.05.020(2), shall conduct an investigation and examination to determine:(1) Whether the person suffers from the problem described;(2) Whether the problem is such that if not treated, or if no child welfare services are provided, there is a probability that similar misconduct will occur in the future;(3) Whether extensive and long term treatment is required;(4) Whether effective treatment or child welfare services for the person's problem are available; and(5) Whether the person is amenable to treatment or willing to cooperate with child welfare services.
