Explicación Simple

Si alguien está en libertad condicional y no sigue las reglas, puede ser llevado de nuevo a la corte. Allí, el juez puede decidir que ya no tiene la libertad y mandarlo a prisión.

Es como cuando estás en un equipo de fútbol y no sigues las reglas del entrenador. Si sigues cometiendo faltas, el entrenador puede sacarte del juego y no dejarte jugar más.

Ejemplo Práctico

Imagina que Juan está en libertad condicional por un delito menor. Un día, la policía lo ve en una fiesta con personas que tienen problemas con la ley. El oficial decide llevarlo de nuevo a la corte. El juez, al ver esto, decide cancelar su libertad condicional y manda a Juan a prisión.

Penalidades

Si se revoca la libertad condicional, puedes ser enviado a prisión según la sentencia previa.

RCW 9.95.220 - Violation of probation -- Rearrest -- Imprisonment Whenever the state parole officer or other officer under whose supervision the probationer has been placed shall have reason to believe such probationer is violating the terms of his probation, or engaging in criminal practices, or is abandoned to improper associates, or living a vicious life, he shall cause the probationer to be brought before the court wherein the probation was granted. For this purpose any peace officer or state parole officer may rearrest any such person without warrant or other process. The court may thereupon in its discretion without notice revoke and terminate such probation. In the event the judgment has been pronounced by the court and the execution thereof suspended, the court may revoke such suspension, whereupon the judgment shall be in full force and effect, and the defendant shall be delivered to the sheriff to be transported to the penitentiary or reformatory as the case may be. If the judgment has not been pronounced, the court shall pronounce judgment after such revocation of probation and the defendant shall be delivered to the sheriff to be transported to the penitentiary or reformatory, in accordance with the sentence imposed. RCW 9.95.230 - Court revocation or termination of probation The court shall have authority at any time prior to the entry of an order terminating probation to (1) revoke, modify, or change its order of suspension of imposition or execution of sentence; (2) it may at any time, when the ends of justice will be subserved thereby, and when the reformation of the probationer shall warrant it, terminate the period of probation, and discharge the person so held.
