Explicación Simple

Si un prisionero es solicitado por otro estado, las autoridades deben informarle y al gobernador. También debe decirle al prisionero que tiene derechos, como hablar con un abogado y contestar la solicitud.

Es como cuando un amigo te pide prestado un libro y tú le avisas al dueño que lo tienes y que tienes derecho a decir si te parece bien o no.

Imagina que Juan está en prisión en Washington y el estado de Oregon quiere llevarlo para un juicio. Las autoridades de la prisión le dicen a Juan que Oregon lo quiere y le explican que puede hablar con un abogado y que tiene tiempo para contestar esta solicitud.

RCW 9.100.070 - Request for temporary custody -- Notice to prisoner and governor -- Advising prisoner of rights In order to implement Article IV(a) of the agreement on detainers, and in furtherance of its purposes, the appropriate authorities having custody of the prisoner shall, promptly upon receipt of the officer's written request, notify the prisoner and the governor in writing that a request for temporary custody has been made and such notification shall describe the source and contents of said request. The authorities having custody of the prisoner shall also advise him in writing of his rights to counsel, to make representations to the governor within thirty days, and to contest the legality of his delivery. RCW 9.100.080 - Copies of chapter -- Transmission Copies of this chapter shall, upon its approval, be transmitted by the secretary of state to the governor of each state, to the attorney general and the secretary of state of the United States, and the council of state governments.
