Si alguien promete hacer una construcción o trabajar en el campo y recibe dinero por adelantado, pero no lo hace y no devuelve el dinero, puede tener problemas legales. Esto es como hacer una promesa y no cumplirla, pero además, hay consecuencias serias por mentir.

Es como cuando le pides a un amigo que te compre un ingrediente para una cena y le das el dinero por adelantado, pero luego no lo hace y ni siquiera te devuelve el dinero. Te sentirías engañado y molesto.

Ejemplo Práctico

Imagina que Juan contrata a Pedro para que le construya una terraza y le paga $1,000 por adelantado. Pedro, sin embargo, decide no hacer el trabajo y no devuelve el dinero. Juan puede demandar a Pedro porque no cumplió con su promesa y no le devolvió el dinero.

Penalidades

Si no se devuelve el dinero, puede considerarse un delito de hurto; si es un contrato agrícola, puede ser un delito menor de clase 3.

Va. Code § 18.2-200.1 - Failure to perform promise for construction, etc., in return for advances. If any person obtain from another an advance of money, merchandise or other thing, of value, with fraudulent intent, upon a promise to perform construction, removal, repair or improvement of any building or structure permanently annexed to real property, or any other improvements to such real property, including horticulture, nursery or forest products, and fail or refuse to perform such promise, and also fail to substantially make good such advance, he shall be deemed guilty of the larceny of such money, merchandise or other thing if he fails to return such advance within fifteen days of a request to do so sent by certified mail, return receipt requested, to his last known address or to the address listed in the contract. 1980, c. 459; 1987, c. 358. Va. Code § 18.2-201 - Advances secured by fraudulent promise to perform agricultural labor. If any person enter into a contract of employment, oral or written, for the performance of personal service to be rendered within one year, in and about the cultivation of the soil, and, at any time during the pendency of such contract, thereby obtain from the landowner, or the person so engaged in the cultivation of the soil, advances of money or other thing of value under such contract, with intent to injure or defraud his employer, and fraudulently refuses or fails to perform such service or to refund such money or other thing of value so obtained, he shall be guilty of a Class 3 misdemeanor.
