Explicación Simple

Si nunca has tenido licencia y te arrestan por manejar una vez sin ella, no necesitas demostrar que tienes seguro. También, si te suspendieron la licencia, eso no significa automáticamente que debes probar que puedes manejar legalmente.

Es como si te detienen por jugar fútbol en el parque sin haber sido registrado en un equipo; una vez que te dicen que no puedes jugar más, no necesitas demostrar que sabes jugar si solo fue un incidente.

Ejemplo Práctico

Imagina que Juan, que nunca ha tenido licencia, decide manejar el auto de su hermano asegurado. Si lo detienen y solo tiene una multa por esto, no le pedirán que demuestre que tiene un seguro. Sin embargo, si le suspendieron la licencia por otra razón, tampoco le exigirán demostrar que puede manejar legalmente.

SECTION 56-9-530. Special exception for certain first convictions for driving without driver's license. Notwithstanding any provision of law to the contrary, any person who has never been issued a license to operate a motor vehicle on the highways of the State of South Carolina and who has been convicted one time of operating a motor vehicle on the highways of the State without a license while driving an insured vehicle shall not, by reason of that fact alone, be required to prove financial responsibility. In addition, any person who has his driving privilege revoked pursuant to Section 56-1-510 is not, by reason of that fact alone, required to furnish proof of financial responsibility.
